Book excerpt: This study summarizes the first five years (1991-96) of agrarian reforms in Ukraine, presenting the results of a farm-level survey conducted in 11 provinces between January and March 1996. The findings show that the growth of private farming has slowed down after a vigorous start and that the number of independent family farms appears to have stabilized at around 33,000. Distribution of land and asset shares has been completed in roughly half the farms surveyed. Ukrainian agriculture remains dominated by large collective structures, and the failure of large farms to adapt to new economic conditions has resulted in a distinct deterioration of their financial performance. The survey suggests that land reform in Ukraine is in danger of stagnation and that the government must create the necessary institutional and market conditions to invigorate reforms.

Agriculture remains the main source of employment and livelihood for the large rural population of many transition countries, especially among the former Soviet republics. Accordingly the World Bank continuously monitors the progress of land reform and farm restructuring in the region because of the potential impact of these processes on rural development and poverty alleviation in rural areas. The present study on Ukraine is the latest addition to a long and growing series of World Bank publications on land reform and farm restructuring in the former socialist countries of Europe and Central Asia. The unique feature of all these publications is their reliance on first-hand empirical information collected through extensive farm surveys of various rural constituencies. Farm surveys have been conducted by the World Bank in many countries of the CIS (Russia, Ukraine, Moldova, Armenia, Georgia, Turkmenistan, Belarus) and Central and Eastern Europe (Poland, Romania, Bulgaria, Hungary, Albania). Analysis of survey findings enables the World Bank to base its policy dialogue with governments in the region on solid empirical facts, making the Bank's recommendation much more credible and relevant. The new findings for Ukraine will similarly provide a platform for useful policy discussions with this country's government and supply the many international donors active on the local scene with essential information for the design of their strategic programs.

Book excerpt: This dissertation investigates law and land reform in post-Soviet Ukraine, focusing on the period after passage of the 2001 Land Code privatizing agricultural land ownership. The line of inquiry follows how legal reorganization of physical space - namely, the creation of national territory and private property -- reconfigures the social and affects performance of the self in contemporary Ukraine. This inquiry is situated in investigation of speech acts, place, and practice. These, in turn, lend insight into interrelationships between subjectivity, sovereignty, and power. I analyze law, commonly thought of as a genre of "performative utterance," as an emergent frame of performance in a context defined by rupture. The principal field sites in which I conducted this fieldwork are Parliament, decollectivized collective farms, and urban properties. In tracing the effects of land privatization, I look at an antecedent social form, the collective farm, and find practices adhering to several subsequent social forms arising in its wake: confiscation, provision, and the sovereign; recollectivization and the corporation; self-sufficiency and the family; roaming and the commons. In my analysis of shelter, urban spaces provide the setting for performances of self and sociability. After exploring a Soviet form of friendship, the informal kollektiv, I describe links between its post-Soviet eclipse and certain changed background structures like the state and its legal guarantees, private property, and new experiences of time. In addition to property, I propose several settings for performance of different forms of the self, including: the present as a shelter for the past, and the synthetic future as a shelter for speech acts neither performative nor parasitic, but still creative of a discursive space for a democratic polity. I investigate ways that law and other discursive practices in post-Soviet Ukraine mark boundaries and produce spaces of inclusion and exclusion. The Soviet Union was defined, in part, by common spaces. This dissertation investigates what happened to forms of the social and the self when those common spaces fragmented.

Book excerpt: Sustainable society development distinctly entails the issues of sustainable use of land and especially soils, which are the place and condition of human activity, the means of production that provide absolute value, and a unique natural resource. Ukraine possesses nine percent of the world's black soil (chernozem) resources, which necessitates the development of sufficient economic and legal mechanisms for their effective use in ensuring food security within the country and worldwide, increasing the export potential of Ukraine subject to the soil quality restoration, and determines the scope of this work. The land reform in Ukraine as a component of economic reform has led to a significant deterioration of agricultural land, loss of humus from soils, their degradation, and other negative consequences threatening the country's economic security and generating socio-economic and demographic crisis phenomena, especially in rural areas. Therefore, the study has identified priorities and has proposed the use of contractual mechanisms in the field of sustainable socio-economic use of land resources. The authors applied an integrated approach to the analysis of sustainable land use issues to achieve the study objective. This led to the use of a wide range of methodological tools, in particular, the dialectical method, the formal logical method, the logical legal method and the methods of analysis, synthesis and comparison. Defined provisions that determine the economic and legal mechanism of land use and should be ensured in the process of sustainable development: meeting the needs of landowners and other persons, including the priority needs - environmental and food security; an increase in the area of land not involved in the economic turnover, the adoption of measures aimed at the preservation and restoration of agricultural land, in particular compliance with the requirements for crop rotation, and, in some cases, their conservation; introduction of contractual relations in the field of land use.
