Book Synopsis International Conventions Affecting Children by : Jeremy Rosenblatt
Download or read book International Conventions Affecting Children written by Jeremy Rosenblatt and published by BRILL. This book was released on 2021-11-22 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: This eminently practical book provides text and expert commentary on all international Conventions that bear directly on the rights of the child. The legal issues covered include, among others, the child and immigration, intercountry adoption, international child abduction, human rights, armed conflict, and maintenance moneys. It is the first book ever to bring together Conventions that can be realistically relied upon in domestic courts, helping practitioners to avoid the pitfall of being deemed academic or distant from legal realities. Drawing on his extensive in-court experience, Jeremy Rosenblatt shows exactly how each Convention may be used to remind courts and judges of their obligations of an international nature, whether or not such Conventions have been incorporated into the domestic system. Among the Conventions presented and discussed, insofar as they bear on children's rights, are the Dublin Convention, the Hague Convention on Intercountry Adoption 1993, the UN Convention on the Rights of the Child, and the Brussels and Lugano Conventions. The author shows how to ensure uniform processes for the protection of the rights of the child everywhere by invoking respective and uniform Conventions that are directly applicable in individual jurisdictions as a result of legal systems globally owning competence and legal comity with one another.

Book Synopsis The Law of Kinship by : Camille Robcis
Download or read book The Law of Kinship written by Camille Robcis and published by Cornell University Press. This book was released on 2013-04-05 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: In France as elsewhere in recent years, legislative debates over single-parent households, same-sex unions, new reproductive technologies, transsexuality, and other challenges to long-held assumptions about the structure of family and kinship relations have been deeply divisive. What strikes many as uniquely French, however, is the extent to which many of these discussions—whether in legislative chambers, courtrooms, or the mass media—have been conducted in the frequently abstract vocabularies of anthropology and psychoanalysis. In this highly original book, Camille Robcis seeks to explain why and how academic discourses on kinship have intersected and overlapped with political debates on the family—and on the nature of French republicanism itself. She focuses on the theories of Claude Lévi-Strauss and Jacques Lacan, both of whom highlighted the interdependence of the sexual and the social by positing a direct correlation between kinship and socialization. Robcis traces how their ideas gained recognition not only from French social scientists but also from legislators and politicians who relied on some of the most obscure and difficult concepts of structuralism to enact a series of laws concerning the family. Lévi-Strauss and Lacan constructed the heterosexual family as a universal trope for social and psychic integration, and this understanding of the family at the root of intersubjectivity coincided with the role that the family has played in modern French law and public policy. The Law of Kinship contributes to larger conversations about the particularities of French political culture, the nature of sexual difference, and the problem of reading and interpretation in intellectual history.

Book Synopsis The International Survey of Family Law by : Andrew Bainham
Download or read book The International Survey of Family Law written by Andrew Bainham and published by Martinus Nijhoff Publishers. This book was released on 1998-02-05 with total page 542 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "International Survey of Family Law," published on behalf of the International Society of Family Law, is the successor to the Annual Survey of Family Law'. It provides information, analysis and comment on recent developments in Family Law across the world on a country-by- country basis. The "Survey" is published annually and its subtitle reflects the calendar year surveyed. Where a country has been regularly surveyed each year, the developments discussed correspond to the year in question. If certain countries have not been surveyed for some years the contributions will usually attempt to cover the intervening period. This applies, for example, in the present volume to the contributions relating to China and Turkey. If countries are being covered for the first time, then more background information will be provided about the state of family law in the country in question. The "Survey" also contains an article dealing with the more significant developments in international law affecting the family.

This book was released on 2023-10-05 with total page 603 pages. Available in PDF, EPUB and Kindle. Book excerpt: This thematic volume in the series Studies in Private International Law – Asia outlines the general choice of law and recognition rules relating to family matters of 15 Asian jurisdictions: Mainland China, Hong Kong, Taiwan, Japan, South Korea, Singapore, Malaysia, Vietnam, Cambodia, Myanmar, the Philippines, Indonesia, Thailand, Sri Lanka and India. The book examines pressing questions and proposes ways in which their systems may be reformed. A concluding chapter considers the extent to which Asian cross-border family law systems can and should be harmonised. The book provides a comprehensive analysis of cross-border family law challenges, including child surrogacy, child abduction, the recognition of same-sex unions, the recovery of maintenance, and the regulation of intercountry adoption. These are among the matters now testing Asian institutions of private international law and acting as forces for their modernisation. With contributions by leading Asian private international law experts, the book proposes necessary reforms for each of the jurisdictions analysed as well as for Asia as a whole.

Book Synopsis Children, the Law and the Welfare Principle by : Kerry O'Halloran
Download or read book Children, the Law and the Welfare Principle written by Kerry O'Halloran and published by Taylor & Francis. This book was released on 2024-02-06 with total page 183 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contrasts and compares the different application of the law relating to the welfare interests and rights of children in France and Germany. It does so by applying the same matrix of indicators to explore jurisdictional differences between welfare interests and rights in the contexts of public family law (civil – care and protection etc and criminal – youth justice etc); private family law (matrimonial, adoption etc); and hybrid public/private family law (wardship, adoption from state care etc). By profiling the nations in accordance with the same indicators it reveals important jurisdictional differences in the extent to which welfare interests or rights determine how the law is currently applied to children in France and Germany. This volume will be of interest to academics and researchers engaged in law, legal studies, and social policy, and also to policymakers, administrators, and professionals working within child welfare systems.
