Si l'adhésion est permise, du fait de la nature de l'entreprise communautaire, elle doit être abordée dans un cadre déterminé par de grands principes. Elle est réservée à des Etats remplissant un certain nombre de conditions qui ont fait l'objet d'une formalisation progressive. Cette conditionnalité, dont la pierre angulaire est constituée par la notion d'acquis implique une préparation des pays candidats. Un cadre juridique global a donc été mis en place afin de rapprocher davantage les pays candidats de l'Union européenne. Cette stratégie de pré-adhésion permet de mobiliser les différentes formes d'assistance aux pays candidats. L'adhésion n'implique pas seulement une mise à niveau des pays candidats, elle suppose aussi des adaptations de l'Union européenne en tant que telle et, de ce fait, conditionne le futur de l'entité. L'adhésion impose une maîtrise des conséquences qu'elle implique, qu'il s'agisse de la réforme institutionnelle et financière ou de l'avenir des politiques communes. L'adhésion pose ainsi la question de la capacité de l'Union européenne à assimiler de nouveaux Etats membres sans porter atteinte à la construction communautaire. La mise en œuvre d'adhésions maîtrisées, respectueuses des principes fondamentaux du projet européen et de ses objectifs, tel est bien le nouveau défi auquel se trouve aujourd'hui confrontée l'Union européenne.

As a consequence, the Union will become subject to the external judicial supervision of an international treaty regime. Individuals will also be entitled to submit applications against the Union, alleging that their fundamental rights have been violated by legal acts rooted in EU law, directly to the Strasbourg Court. As the first comprehensive monograph on this topic, this book examines the concerns for the EU's legal system in relation to accession and the question of whether and how accession and the system of human rights protection under the Convention can be effectively reconciled with the autonomy of EU law. It also takes into account how this objective can be attained without jeopardising the current system of individual human rights protection under the Convention. The main chapters deal with the legal status and rank of the Convention and the Accession Agreement within Union law after accession; the external review of EU law by Strasbourg and the potential subordination of the Luxembourg Court; the future of individual applications and the so-called co-respondent mechanism; the legal arrangement of inter-party cases after accession and the presumable clash of jurisdictions between Strasbourg and Luxembourg; and the interplay between the Convention's subsidiarity principle (the exhaustion of local remedies) and the prior involvement of the Luxembourg Court in EU-related cases. The subject matter of this paper is to investigate the benefits and costs of the accession of Eastern European countries into the EU and the political constraints that arise from this cost benefit analysis. The main message is that while the authors do believe that the accession will be beneficial for the enlarged union as a whole there will be obviously groups that will gain more than others. This will be partly because some groups will be more successful in maximising their benefits from the EU budget than others but also because the economic benefits per se will not be equally distributed across all member states and population groups. The first part summarises the economic benefits of the accession process and is followed by a quick look at the costs. The third part looks at political economy aspects of the implementation and points out problem areas.
