Available in PDF, EPUB and Kindle. Book excerpt: The sixth revised edition of Industrial Relations and Labour Laws captures the significant developments that have taken place in the realm of labour laws and industrial relations in the recent past. The most notable development in the legislative sphere is the amendment in the Industrial Disputes Act, 1947 in 2010. In the judicial sphere, there has been a marked shift in the approach of the Indian judiciary in the area of discipline and disciplinary procedure. Moreover, new norms/principles have been evolved to determine the classification of a person as a workman, provide relief in case of illegal/wrongful termination of service of workmen, determine notice period for strike/lock-out in public utility services and for regularization of services of daily, temporary, casual or contract workers. Extensively revised and updated in line with the changes in the law, this edition also gives a new and more holistic dimension to the subject of labour--management relations. • Part I provides the contextual and constitutional framework of labour law and an overview of industrial relations. • Part II deals with the trade union movement, employers’ organizations and laws relating to trade unions, collective bargaining, unfair labour practices and victimization. • Part III deals with regulation of industrial disputes, persuasive, coercive and voluntary processes for settlement of industrial disputes, grievance procedure, government’s power of reference, laws relating to instruments of economic coercion, management of discipline, laws relating to change in conditions of service and lay-off, retrenchment, transfer and closure. • Part IV examines laws relating to standing orders. • Part V is on workers’ participation in management. This edition will serve as a comprehensive textbook for students of LLB, LLM, MBA, MSW, MPA, CS, and masters and diploma programmes in personnel management, industrial relations and labour law. It is indispensable for personnel managers, law officers, lawyers, trade union officials/ members, officials of labour department and members of the labour judiciary.

Book excerpt: Presenting a new approach towards the social history of working classes in the imperial context, this book looks at the formation of working classes in Scotland and Bengal. It analyses the trajectory of labour market formation, labour supervision, cultures of labour and class formation between two regional economies – one in an imperial country and the other in a colonial one. The book examines the everyday lives of the jute workers of the imperial nexus, and the impact of the ‘Dundee School’ of Scottish mechanics, engineers and managers who ran the Calcutta jute industry. It goes on to challenge existing theories of imperialism, class formation and class struggle – particularly those that underline the exceptional nature of the Indian experience of industrialization - and demonstrates how and why Empire was able to provide an opportunity to test and perfect ways of controlling the lower classes of Dundee. These historical debates have a continued relevance as we observe the impact of globalization and rapid industrialization in the so-called developing world and the accompanying changes in many areas of the developed world marked by de-industrialization. The book is of use to scholars of imperial history, labour history, British history and South Asian history.

Available in PDF, EPUB and Kindle. Book excerpt: In most globalizing economies, workers engaged in the informal sector occupy the lowest rungs of society. This book examines one such group—stone quarry workers located beyond the expanding rim of south Delhi and beneath the radar of effective law and policy. Drawing upon extensive case studies and personal narratives of this labouring class, Talib focuses on their inner world and interprets their life stories. He records the dwindling oral tradition of these people and brings to the fore the dynamics of survival. Questioning the discourse that views this group as passive objects, the book portrays them as active negotiators of their own circumstances. This work is crucial to an understanding of the current debates on labour and development studies. It presents the workers' story of social exclusion and struggle for survival, which is rarely heard amidst the counter narratives of the formal sector's economic boom.

Available in PDF, EPUB and Kindle. Book excerpt: The colonial administration passed a Factory Act in 1881, producing the first official definition of ‘factory’ in modern Indian history—as a workplace using steam power and regularly employing over 100 workers. In 1891, the Act was amended: factories were redefined as workplaces employing over 50 workers; the upper age limit of legal ‘protection’ was raised; weekly holidays were established; and women mill-workers were brought within its ambit. Sarkar analyses the two versions of the Act and reveals the tensions inherent within the project of protective labour regulation. Combining legal and social history, he identifies an emergent ‘factory question’. The cotton mill industry of Bombay, long considered as one of the birthplaces of modern Indian capitalism, is the principal focal point of his investigation. Factory law, though experienced as a minor official initiative, connected with some of the most potent ideological debates of the age. Trouble at the Mill explores a shifting set of themes and raises questions rarely thematized by labour historians—the ideologies of factory reform, the politics of factory commissions, the routines of factory inspection, and the earliest waves of strike action in the cotton textile industry in the last quarter of the nineteenth century.

Available in PDF, EPUB and Kindle. Book excerpt: Social movements hasn't been a popular topic with researchers, making up less than 3 per cent of all studies in history, political science, sociology and anthropology sponsored by the Indian Council of Social Science Research (ICSSR) up to the mid-nineties. The research has had an 'institutional' or 'government' skew, in that, the study of the politics of the masses has been largely ignored. There are reasons of history behind this, but what has been consistently lost sight of is the fact that in the absence of an understanding of the politics of the masses, the functioning of the state can be understood only partially. This volume is a revised and enlarged edition of the author's review of literature on social movements in India, first commissioned by the ICSSR. After careful deliberation on the 'ideal' definition of a 'social movement', the author adopts for this volume the loose idea of 'non-institutionalised collective political action striving for social and political change'. On the basis of the socio-economic characteristics of participants and the issues involved, this volume makes a nine-fold classification of social movements: peasant movements, tribal movements, dalit movements, backward caste movements, women's movements, working class movements, students' movements, middle class movements and human rights and environmental movements (added in this edition). This book is important as much for filling a scholarly lacuna in social science studies as for proposing--and executing--an orderly classification of literature on social movements in modern India. The original, shorter, monograph received an enthusiastic response from both scholars and laypersons, and this volume is likely to be welcomed similarly.
