Book excerpt: This guide is a practical tool for those involved in national legislative processes and in the design of labour laws, including government officials and representatives of workers' and employers' organisations. At the 100th International Labour Conference in June 2011, the ILO adopted Convention No. 189 and Recommendation No. 201 on decent work for domestic workers. Because domestic workers are often excluded from the protection of labour laws or are treated less favourably than other wage workers, implementing the basic principles embodied in Convention No. 189 calls for an assessment and strengthening of national labour laws. With the Convention No. 189 as its underlying framework, this volume provides specific guidelines and complements these with examples drawn from a wide range of existing national labour laws concerning domestic workers. The guide's first part discusses alternative approaches to regulating domestic work, the nature and characteristics of domestic work, the forms of employment relationships that may exist, and their implications for regulation. Subsequent chapters focus on substantive areas of regulation, namely formalizing the employment relationship, working time, remuneration, fundamental principles and rights at work, protection from abuse and harassment, and protection of migrant domestic workers and child domestic workers.

Available in PDF, EPUB and Kindle. Book excerpt: Labour law has traditionally aimed to protect the employee under a hierarchy built on constitutional provisions, statutory law, collective agreements at various levels, and the employment contract, in that order. However, in employment regulation in recent years, ‘flexibility’ has come to dominate the world of work – a set of policies that reshuffle the relationship among the fundamental pillars of labour law and inevitably lead to degrading the protection of employees. This book, the first-ever to consider the sources of labour law from a comparative perspective, details the ways in which the traditional hierarchy of sources has been altered, presenting an international view on major cross-cutting issues followed by fifteen country reports. The authors’ analysis of the changing hierarchy of labour law sources in the light of recent trends includes such elements as the following: the constitutional dimension of labour rights; the normative intervention by the State; the regulatory function of collective bargaining and agreements; the hierarchical organization of labour law sources and the ‘principle of favour’; the role played by case law in both common law and civil law countries; the impact of the European Economic Governance; decentralization of collective bargaining; employment conditions as key components of global competitive strategies; statutory schemes that allow employees to sign away their rights. National reports – Australia, Brazil, China, Denmark, France, Germany, Hungary, Italy, Poland, Russia, Spain, Sweden, South Africa, the United Kingdom and the United States – describe the structure of labour law regulations in each legal system with emphasis on the current state of affairs. The authors, all distinguished labour law scholars in their countries, thus collectively provide a thorough and comprehensive commentary on labour law regulation and recent tendencies in national labour laws in various corners of the globe. With its definitive analysis of such crucial matters as the decentralization of collective bargaining and how individual employment contracts can deviate from collective agreements and statutory law, and its comparison of representative national labour law systems, this highly informative book will prove of inestimable value to all professionals concerned with employment relations, labour disputes, or labour market policy, especially in the context of multinational workforces.

Book excerpt: Social security is a basic human right and a fundamental means for creating social cohesion; it is important not only for the well-being of workers, but also for their families and other community members at large. An indispensable part of government social policy, social security is an important tool to alleviate poverty and if well managed can enhance productivity by providing income security and social services. Through a growing economy and active labour market policies, social security serves as an instrument for sustainable social and economic development. Whereas social security is a cost for formal organizations, it is also a future investment for the well-being of the people. With globalization and structural adjustment policies, social security becomes more necessary today than ever. Social Security Challenges in Tanzania: Transforming the Present - Protecting the Future includes a comprehensive overview of social security perspectives at both the international and regional level. The text focuses specifically on Tanzania, analyzing in detail the policy and legal frameworks for social security provision. Engaging and authoritative, it is an essential text for those interested in the evolution, current challenges, and opportunities in addressing the needs of Tanzanians through social security provisions.

Book excerpt: Nearly half of trade agreements concluded in the past five years included either a labor chapter or labor provision that makes reference to international labor standards and ILO instruments. The evidence so far suggests that labor provisions have been an important tool for raising awareness and improving laws and legislations with respect to workers' rights, increasing stakeholder involvement in negotiation and implementation phases, and developing domestic institutions to better monitor and enforce labor standards. But challenges remain, particularly with respect to sustainability of impacts, coherence, and cooperative efforts. This new report, part of the Studies on Growth with Equity series, gives a full examination of the scope and effectiveness of these labor provisions.

Book excerpt: This innovative volume is focused on the relationship between religion on the one hand and political and judicial rights on the other. At a time when the so-called ‘checks and balances’ that guarantee the vulnerable equilibrium between legislative, executive and judicial branches of governance are increasingly under pressure, this book offers valuable insights. It presents empirical work that has measured young people’s attitudes and explains the variety found across their views. Readers will find answers to the question: To what extent do youths in different countries support political and judicial human rights and what influences their attitudes towards these rights? The political rights in this question include, among others, active and passive voting right, the right to protest, and the rights of refugees. Judicial rights refer in general to the right of a fair trial, and include principles like equality before the law; the right to independent and impartial judgement; the presumption of innocence; the right to legal counsel; and the privilege against self-incrimination. Expert contributing authors look at aspects such as religious beliefs and practices, personal evaluation of state authorities, and personality characteristics. The authors discuss contextual determinants for attitudes towards political and judicial rights, in both theory and empirical indicators. Numerous helpful tables and figures support the written word. This book makes an original contribution to research through the empirical clarification of factors that induce or reduce people’s support of political and judicial rights. It will appeal to graduates and researchers in religious studies, philosophy or sociology of religion, among other disciplines, but it will also interest the general reader who is concerned with matters of human rights and social justice.

Book excerpt: Fifteen in a series of annual reports comparing business regulation in 190 economies, Doing Business 2018 measures aspects of regulation affecting 10 areas of everyday business activity: • Starting a business • Dealing with construction permits • Getting electricity • Registering property • Getting credit • Protecting minority investors • Paying taxes • Trading across borders • Enforcing contracts • Resolving insolvency These areas are included in the distance to frontier score and ease of doing business ranking. Doing Business also measures features of labor market regulation, which is not included in these two measures. The report updates all indicators as of June 1, 2017, ranks economies on their overall “ease of doing business†?, and analyzes reforms to business regulation †“ identifying which economies are strengthening their business environment the most. Doing Business illustrates how reforms in business regulations are being used to analyze economic outcomes for domestic entrepreneurs and for the wider economy. It is a flagship product produced in partnership by the World Bank Group that garners worldwide attention on regulatory barriers to entrepreneurship. More than 137 economies have used the Doing Business indicators to shape reform agendas and monitor improvements on the ground. In addition, the Doing Business data has generated over 2,182 articles in peer-reviewed academic journals since its inception. This book was released on 2017-05-15 with total page 71 pages. Available in PDF, EPUB and Kindle. Book excerpt: Master's Thesis from the year 2017 in the subject Law - Comparative Legal Systems, Comparative Law, , course: Master of Laws in Mediation and Arbitration, language: English, abstract: Upon reform of land laws in 1999 following the National Land Policy of 1995 the new system for adjudication on land disputes aimed at adopting a procedure which is not tied to legal technicalities and that which is not strictly bound by rules of practice or procedure but which aims at delivering substantial justice. That’s why land laws embody some forms of ADR. The main purpose of this study was therefore to examine the effectiveness of ADR legal framework in Tanzania and how useful it is in resolving land disputes. ADR processes currently in use in Tanzania are critically examined and their shortcomings reviewed. The legal framework for ADR and the role they play in providing the supporting structure for land dispute resolution are evaluated. Future prospects for ADR are indicated and recommendations for successful implementation of ADR in resolving land disputes are given. The study has revealed that despite the specialized court system for land disputes settlement there is no distinct legal regime for use of ADR at all levels of land dispute settlement machinery. The only method of ADR in use at the High Court level is mediation through court annexed mediation like in any other civil cases though there are no procedural Rules guiding the same. Negotiation is rarely used where parties to the dispute opt to resolve the matter out of court and then file a deed of settlement in court.

Available in PDF, EPUB and Kindle. Book excerpt: Today, Alternative Dispute Resolution (ADR) has gained international recognition and is widely used to complement the conventional methods of resolving disputes through courts of law. ADR simply entails all modes of dispute settlement/resolution other than the traditional approaches of dispute settlement through courts of law. Mainly, these modes are: negotiation, mediation, [re]conciliation, and arbitration. The modern ADR movement began in the United States as a result of two main concerns for reforming the American justice system: the need for better-quality processes and outcomes in the judicial system; and the need for efficiency of justice. ADR was transplanted into the African legal systems in the 1980s and 1990s as a result of the liberalization of the African economies, which was accompanied by such conditionalities as reform of the justice and legal sectors, under the Structural Adjustment Programmes. However, most of the methods of ADR that are promoted for inclusion in African justice systems are similar to pre-colonial African dispute settlement mechanisms that encouraged restoration of harmony and social bonds in the justice system. In Tanzania ADR was introduced in 1994 through Government Notice No. 422, which amended the First Schedule to the Civil Procedure Code Act (1966), and it is now an inherent component of the country's legal system. In recognition of its importance in civil litigation in Tanzania, ADR has been made a compulsory subject in higher learning/training institutions for lawyers. This handbook provides theories, principles, examples of practice, and materials relating to ADR in Tanzania and is therefore an essential resource for practicing lawyers as well as law students with an interest in Tanzania. It also contains additional information on evolving standards in international commercial arbitration, which are very useful to legal practitioners and law students.
