La distinzione adottata, di cui non sempre viene dato atto in dottrina e in giurisprudenza, è sostanziale corrisponde specularmente alle relative forme di affidamento statuite dagli artt. 337-ter e 337-quater c.c. In ogni caso i rimedi processuali previsti dal legislatore in caso di violazione dei predetti diritti e doveri sono assolutamente identici sia nei casi in cui il genitore non collocatario violi il proprio dovere o subisca violazioni al proprio diritto di frequentare la prole, sia nelle ipotesi in cui il genitore non affidatario non adempia al proprio obbligo o venga leso nel proprio diritto di visita dei figli affidati all'altro genitore.
