Book excerpt: En France, sous la Ve République, la crise de la responsabilité politique des gouvernants membres du pouvoir exécutif (président de la république et ministres) est souvent soulignée par la doctrine et les acteurs politiques. Leurs analyses, citées et étudiées tout au long de cette thèse, laissent supposer que le principe " responsabilité politique " est de plus en plus bafoué. L'existence de dysfonctionnements ne peut être niée. Cependant tel n'est pas, en soi, l'objet de cette thèse. La finalité poursuivie est de démontrer que la responsabilité politique est la seule responsabilité concevable pour les gouvernants et que la Ve République peut être présentée comme l'âge d'or de la responsabilité politique. Cette conclusion s'impose lors d'une mise en perspective, d'une part, du texte constitutionnel de 1958 avec les textes constitutionnels des régimes successifs depuis 1789, et, d'autre part, des phénomènes politiques sous la Ve République et dans les régimes précédents. Tout d'abord, la comparaison est favorable au régime de la Ve République. Les auteurs de la Constitution de 1958 l'ont élaborée en tenant compte des pratiques et des textes antérieurs mais aussi des projets de réforme formulés par certains. De plus, les membres des pouvoirs exécutif et législatif ont su innover et étendre les mécanismes de mise en jeu de la responsabilité politique. Les mailles du contrôle parlementaire sont à la fois plus denses et plus cohérentes qu'avant 1958. Outre la réforme du mode d'élection du président de la République et de la durée de son mandat, le recours au référendum et au droit de dissolution, comme les différents scrutins locaux, nationaux et européens ont un impact sur les membres du pouvoir exécutif et la politique définie et appliquée. L'effet s'amplifie au fil des décennies. Certes, cette extension laisse l'impression d'être déstructurée. Elle n'en demeure pas moins le reflet d'une évolution. Le régime de la responsabilité politique est devenu un polyrégime, dépassant le cadre parlementaire, et un révélateur de la déparlementarisation de la Ve République. Ensuite, la responsabilité politique est la seule responsabilité envisageable pour apprécier l'action des gouvernants. Elle est intrinsèquement nécessaire et opportune. Son émergence est le fruit de la maturation des régimes politiques. Son essence s'est avérée rapidement indispensable pour agir en politique et agir sur le politique. Sa construction juridique nous renseigne sur les choix intellectuels et philosophiques réalisés par des acteurs du jeu politique à certaines époques dans une logique d'action et/ou de réaction à des faits. Elle est porteuse de valeurs et doit être considérée comme un standard dans une démarche d'analyse des phénomènes politiques et de formulation de choix politiques. A présent, le rapport conflictuel que la classe politique et les citoyens entretiennent avec cette responsabilité révèle les doutes qui secouent notre société. Quoi qu'il en soit, la responsabilité politique est un mode apaisé de résolution des conflits politiques dont la finalité première est d'assurer une harmonie entre le pouvoir exécutif et le pouvoir législatif. Ce dernier doit être le gardien vigilant de cette cohésion, et de cette cohérence. Le renforcement du cadre parlementaire est fondamental pour assurer la sauvegarder de cette responsabilité. Consolider les trois phases de sa mise en jeu –phases déjà inscrites dans le texte constitutionnel et le règlement des assemblées–, est une exigence politique : la première phase est une phase d'anticipation, intervenant en amont, lors de la formation du gouvernement. La deuxième phase est une phase intermédiaire, la phase de contrôle de l'action gouvernementale par l'information. Au cours de cette phase, les parlementaires doivent veiller au respect de la volonté nationale par le gouvernement pour que cette cohésion politique entre les pouvoirs se maintienne et éviter ainsi le recours à la dernière phase, la phase de sanction. Cette ultime phase, qui peut se traduire par le renversement d'un gouvernement récalcitrant aux attentes formulées préalablement par la majorité, n'est pas une fin en soi. Elle est le reflet d'un désaccord et l'annonce d'une nouvelle ère.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
