Avant toute démarche d'analyse du droit positif, il semble nécessaire de clarifier le concept de personnalité juridique internationale, loin d'être univoque. Un bilan doctrinal permet de dégager trois définitions, qui varient en fonction du degré d'exigence des critères qui composent la personnalité. Le point de départ théorique choisi utilise une définition composée de deux critères: la titularité de droits et obligations internationaux, ainsi que la capacité processuelle de faire valoir les premiers et d'assumer les seconds. Les rapports de l'individu avec l'ordre international sont indissociables de la notion d'écran étatique. Dans un mouvement descendant, il résiste à l'entrée du droit international qui doit atteindre l'individu dans l'ordre interne. A l'inverse, dans un sens ascendant, il empêche J'individu de sortir de l'ordre étatique pour agir directement dans l'ordre juridique international. Entre résistance et transparence, l'évolution de cet écran est significative d'une acquisition progressive d'un statut international par l'individu.
