Examining this defining process, distinguished historians focus on the evolution of Mexican liberalism from the perspectives of politics, the military, the Church, and the economy. Based on extensive archival research, the chapters demonstrate that--despite widely held assumptions--liberalism was not an alien ideology unsuited to Mexico's traditional, conservative, and multiethnic society. On the contrary, liberalism in New Spain arose from Hispanic culture, which drew upon a shared European tradition reaching back to ancient Greece. This volume provides the first systematic exploration of the evolution of Mexican liberal traditions in the nineteenth century. The chapters assess the changes in liberal ideology, the nature of federalism, efforts to create stability with a liberal monarchy in the 1860s, the Church's accommodation to the new liberal order, the role of the army and of the civil militias, the liberal tax system, and attempts to modernize the economy in the latter part of the century. For some, the fabled Apache was a hero, an indigenous Robin Hood who fought oppressive Spaniards to help the dispossessed and downtrodden. For others, he was little more than a merciless killer. In Son of Vengeance, Bradley Folsom sets out to find the real Rafael—to extract the true story from the scant historical record and superabundance of speculation. What he uncovers is that many of the legends about Rafael were true: he was both daring and one of the most prolific serial killers in North American history. Rafael was born into an Apache family, but from a young age he was raised by Spanish chaplain Rafael Nevares, who took his indigenous prodigy out on patrol with local soldiers and taught him to speak Spanish and practice Catholicism. Rafael’s forced assimilation heightened the tension between his ancestry and the Hispanic environment and spurred him to violence. Sifting Spanish military and government documents, church records, contemporary newspapers, and eyewitness accounts, Folsom reveals a three-dimensional historical figure whose brutality was matched and abetted by great ingenuity—and by a deep, long-standing hostility between the Spanish and the Apaches of New Spain. The early years of tutelage under Nevares also, perversely, contributed to Rafael’s brutal success. Rather than leading to a life of Christian piety and Spanish loyalty, the knowledge Rafael gained from his mentor served instead to help him evade his pursuers and the law, at least for a time. In Son of Vengeance, we see the real El Indio Rafael for the first time—the man behind the cultural myth, and the historical forces and circumstances that framed and propelled his feats of violence.

Book excerpt: This book is a radical reinterpretation of the process that led to Mexican independence in 1821—one that emphasizes Mexico's continuity with Spanish political culture. During its final decades under Spanish rule, New Spain was the most populous, richest, and most developed part of the worldwide Spanish Monarchy, and most novohispanos (people of New Spain) believed that their religious, social, economic, and political ties to the Monarchy made union preferable to separation. Neither the American nor the French Revolution convinced the novohispanos to sever ties with the Spanish Monarchy; nor did the Hidalgo Revolt of September 1810 and subsequent insurgencies cause Mexican independence. It was Napoleon's invasion of Spain in 1808 that led to the Hispanic Constitution of 1812. When the government in Spain rejected those new constituted arrangements, Mexico declared independence. The Mexican Constitution of 1824 affirms both the new state's independence and its continuance of Spanish political culture.

One of great figures in the field, the Argentinian legal historian Víctor Tau Anzoátegui, published in 1997 his Nuevos horizontes en el estudio histórico del derecho indiano. The book, in which Tau addressed seminal methodological questions setting tone for the discipline’s future orientation, proved to be the starting point for an important renewal of the discipline. Tau drew on the writings of legal historians, such as Paolo Grossi, Antonio Manuel Hespanha, and Bartolomé Clavero. Tau emphasized the development of legal history in connection to what he called “the posture superseding rational and statutory state law.” The following features of normativity were now in need of increasing scholarly attention: the autonomy of different levels of social organization, the different modes of normative creativity, the many different notions of law and justice, the position of the jurist as an artifact of law, and the casuistic character of the legal decisions. Moreover, Tau highlighted certain areas of Spanish colonial law that he thought deserved more attention than they had hitherto received. One of these was the history of the learned jurist: the letrado was to be seen in his social, political, economic, and bureaucratic context. The Argentinian legal historian called for more scholarly works on book history, and he thought that provincial and local histories of Spanish colonial law had been studied too little. Within the field of historical science as a whole, these ideas may not have been revolutionary, but they contributed in an important way to bringing the study of Spanish colonial law up-to-date. It is beyond doubt that Tau’s programmatic visions have been largely fulfilled in the past two decades. Equally manifest is, however, that new challenges to legal history and Spanish colonial law have emerged. The challenges of globalization are felt both in the historical and legal sciences, and not the least in the field of legal history. They have also brought major topics (back) on to the scene, such as the importance of religious normativity within the normative setting of societies. These challenges have made scholars aware of the necessity to reconstruct the circulation of ideas, juridical practices, and researchers are becoming more attentive to the intense cultural translation involved in the movement of legal ideas and institutions from one context to another. Not least, the growing consciousness and strong claims to reconsider colonial history from the premises of postcolonial scholarship expose the discipline to an unseen necessity of reconsidering its very foundational concepts. What concept of law do we need for our historical studies when considering multi-normative settings? How do we define the spatial dimension of our work? How do we analyze the entanglements in legal history? Until recently, Spanish colonial law attracted little interest from non-Hispanic scholars, and its results were not seen within a larger global context. In this respect, Spanish colonial law was hardly different from research done on legal history of the European continent or common law. Spanish colonial law has, however, recently become a topic of interest beyond the Hispanic world. The field is now increasingly seen in the context of “global legal history,” while the old and the new research results are often put into a comparative context of both European law of the early Modern Period and other colonial legal orders. In this volume, scholars from different parts of the Western world approach Spanish colonial law from the new perspectives of contemporary legal historical research."

Before independence in 1821, the isolated territory that we now call El Salvador was a subdivision of the Captaincy General of Guatemala and had only 250,000 inhabitants. Both indigo production, the source of wealth for the country's tiny elite and its main link to the outside world, and subsistence agriculture, which engaged the majority of the population, involved the use of agricultural techniques that had not changed for two hundred years. By 1900, however, El Salvador's primary export was coffee, a crop that demanded relatively sophisticated agricultural techniques and the support of an elaborate internal finance and marketing network. The coffee planters came to control the state apparatus, writing laws that secured their access to land, imposing taxes that paid for a transportation network designed to service their plantations, building ports to expedite coffee exports, and establishing a banking system to finance the new crop. Weak Foundations shows how the parallel process of state-building and expansion of the coffee industry resulted in the formation of an oligarchy that was to rule El Salvador during the twentieth century. Historians and economists interested in the "routes to underdevelopment" followed by Latin American and other "Third World" countries will find this analysis thorough and provocative.
