La définition même de la notion économique d'entreprise en difficulté a été voulue suffisamment large pour englober l'ensemble des droits et interventions des salariés, à travers l'ensemble des mécanismes de prévention et de traitement des difficultés mis en place par les lois du 01-03-1984 et du 25-01-1985. Dans le contexte d'un droit de la "régulation" de l'entreprise en crise. L'analyse met en relief deux aspects fortement contrastés, mais que le législateur a voulu concilier : d'une part, un droit "économique" du travail et de l'emploi qui, lui-même, s'articule en deux volets complémentaires : les droits d'information, de consultation et d'initiative des salaries et de leurs institutions représentatives, aussi bien au stade de la prévention des difficultés (loi du 01-03-1984) qu'au stade du traitement (loi du 25-01-1985) : la protection spécifique de l'emploi dans le cadre de la loi du 25-01-1985 (arts. 1er 81, 85, 155 etc). De la combinaison des deux volets précités résulte une volonté de structurer la collectivité de travail au moment ou celle-ci se trouve le plus fortement menacée ; c'est en ce sens que l'on peut parler d'un "salarié membre d'une collectivité de travail". D'autre part, un droit plus traditionnel, de "protection" des intérêts financiers du salarié dans le cadre de la loi du 25 01 85, qui, lui-même, se décompose en deux volets : le salarié créancier de l'entreprise en difficulté (l'étude des mécanismes de traitement et de paiement de la créance que détient le salarié contre l'entreprise) ; le salarié et l'AGS (analyse de l'intervention de cet organisme au profit des salariés et des modalités de cette intervention).

The Council of Europe suggests reconciling social cohesion with the inevitable changes wrought by globalisation, namely the reorganisation of the parameters governing competition. This reconciliation should take into account the essential political value of democratic security, to be found firstly in employment; the high social and societal cost of precariousness attests to this. However, security should not imply rigidity. It should rather translate into societal recognition of a "right to transition" which calls for co-responsibility on the part of all social actors and stakeholders. Reconciliation is more than a political duty, it is a prerequisite for the stability necessary for social sustainability.
