The topic is connected to the theme of the image of the city, which is extended to the territory scale and applied to case studies in Italy’s Umbria region, where the goal is to strike a dynamic balance between cultural heritage and nature. The studies demonstrate how landscape represents an interpretive process of finding meaning, a product of the relationships between mankind and the places in which it lives. The work proceeds from the assumption that it is possible to describe these connections between environment, territory and landscape by applying the Vitruvian triad, composed of Firmitas (solidity), Utilitas (utility) and Venustas(beauty). The environment, the sum of the conditions that influence all life, represents the place’s solidity, because it guarantees its survival. In turn, territory is connected to utility, and through its etymological meaning is linked to possession, to a domain; while landscape, as an “area perceived by people”, expresses the search for beauty in a given place, the process of critically interpreting a vision.

Monetary penalties outnumber all other sanctions delivered by criminal justice in many jurisdictions, imprisonment included. More people pay fines than go to prison and in some jurisdictions many of those in prison are there because of failure to pay their fines. Therefore, it is surprising how little has been written in the Anglophone academic world about the nature of money sanctions and their specific characteristics as legal sanctions. In many ways, legal innovations related to money sanctions have been poorly understood. This book argues that they are a direct consequence of the changing meaning of money. Considering the ‘meaninglessness’ of modern money, the book aims to examine the history of changing conceptions in how fines have been conceived and used. Using a set of interpretative techniques sensitive to how money and freedom are perceived, the genealogy of the penal fine is presented as a story of constant reformulation in response to shifting political pressures and changes in intellectual developments that influenced ideological commitments of legislators and practitioners. Book excerpt: Disgorgement of profits is not exactly a household word in private law. Particularly in civil law jurisdictions – as opposed to those of the common law – the notion is not well known. What does it stand for? It is best illustrated by examples. One of the best known being the British case of Blake v Attorney General, [2001] 1 AC 268. In which a double spy had been imprisoned by the UK government before escaping and settling in the former Soviet Union. While there wrote a book on his experiences, upon which the UK government claimed the proceeds of the book. The House of Lords, as it then was, allowed the claim on the basis of Blake’s breach of his employment contract. Other examples are the infringement of intellectual property rights, where the damages of the owner are limited, but the profits of the wrongdoer immense. In such cases, the question arises whether the infringing party should be disgorged of his profits. This volume aims at establishing the notion of disgorgement of profits as a keyword in the discourse of private law. It does not purport to answer the question whether or not such damages should or should not be awarded. It does however aim to contribute to the discussion, the arguments in favour and against, and the organisation of the various actions.

Divided in five parts, the book begins with the coin currency of the Middle Ages, moving through the invention of nominalism in the early modern period to cashless payment and the rise of the banking system and paper money, then charting the progression to fiat money in the modern era. Each part commences with an overview of the monetary environment for the historical period written by an economic historian or numismatist. These are followed by chapters describing the legal doctrines of each period in civil and common law. Each section contains examples of contemporary litigation or statute law which engages with the distinctive issues affecting the monetary law of the period. In this work, our aim was to ascertain whether the new social ŇgameÓ is actually providing wealth for players, and examine any theoretical implications of the growing overlap between dialogue and sale, between market and society or, more simply, between money and gift. A review of recent literature is followed by discussion of logic and empirical evidence, which leads into a focus on the convergence currently taking place between the roles of customer and citizen. We develop a new theory of convergence and test it through a specially developed model of a Ňco-value chainÓ. The metrics of the Covalue Model are used to measure and clarify the roles of customers, companies and communities. The model is applied to a large number of recent case histories, providing a topical focus on implications for management.
