Available in PDF, EPUB and Kindle. Book excerpt: This book examines accountability issues and the problems of regulating non-governmental organisations (NGOs) through self-regulation. It focuses on methods of self-regulation for NGOs in response to prominent scandals that revealed problems with their accountability, notably the ‘Mafia Capitale’ scandal in Italy and the Oxfam GB scandal in Haiti. It also touches upon other accountability failures, including the allegations against the WWF of facilitating human rights abuses of indigenous groups in Cameroon. The work brings a legal approach to the topic of NGO self-regulation and accountability, contributing to the academic and policy debate in several ways. It advances a brand-new theoretical model to explain the reasons behind NGOs non-compliance with self-regulation, examines the reasons for self-regulation failures, identifies new accountability routes, and recommends proposals for sectoral reform. The book will be of great interest to scholars, researchers and PhD students who work in the area of NGO regulation and accountability from a legal perspective as well as to accountability and NGO scholars working in other disciplines. It will also appeal to practitioners and policymakers who work on the development of NGO policies.

Book excerpt: This book explores the relationship between the sciences of representation and the strategy of landscape valorisation. The topic is connected to the theme of the image of the city, which is extended to the territory scale and applied to case studies in Italy’s Umbria region, where the goal is to strike a dynamic balance between cultural heritage and nature. The studies demonstrate how landscape represents an interpretive process of finding meaning, a product of the relationships between mankind and the places in which it lives. The work proceeds from the assumption that it is possible to describe these connections between environment, territory and landscape by applying the Vitruvian triad, composed of Firmitas (solidity), Utilitas (utility) and Venustas(beauty). The environment, the sum of the conditions that influence all life, represents the place’s solidity, because it guarantees its survival. In turn, territory is connected to utility, and through its etymological meaning is linked to possession, to a domain; while landscape, as an “area perceived by people”, expresses the search for beauty in a given place, the process of critically interpreting a vision.

Book excerpt: This book is a retrospective view of modern philosophical anthropology through the works of two of its greatest exponents. the author demonstrates how mythology, the philosophy of history and language and Vico's concept of man had as a constant referral point Malebranche's psychology with its Cartesian formulation. The idolatrous and mythopoietic imagination that is described in La Scienza Nuova (New Science) has much in common with the "pagan" mind (that is to say the mind subjugated to passions, sensitivity and fantasy that is described in La Recherche (The Search after Truth). Some of the themes discussed here are myth, the metaphoric nature of thought, idolatry, the formation of mentality, the relationships which bind passions and representations and the association of ideas through iconic images. Also discussed are other themes such as the structure of society and imagination, imitation, persuasion and social relationships, communication within society between illustrious imaginations. Moreover in Malebranche has been found a complex and complete theory of imaginative universals (universali fantastici). The philosophy of the imagination in Vico and Malebranche is translated and edited by Giorgio A. Pinton.

Available in PDF, EPUB and Kindle. Book excerpt: 'Alberto Brugnoli and Alessandro Colombo have put together an important collection of essays on government and governance in Italy and Britain. This richly documented comparative study proposes to answer two key questions: how does the change from government to governance emerge, and what enables this transformation to survive and even to displace State-centric solutions to public policy issues? The book will be a milestone in highlighting the distinctive and original role of the principle of subsidiarity, in examining and assessing governance regimes, their philosophy and their organizational choices and in linking subsidiarity with the prospects of freedom, responsibility and self-governing societies in the modern world. I know of no other book that brings the principle of subsidiarity to the frontier of the most current research in social science.' – Filippo Sabetti, McGill University, Canada This unique and original book focuses on institutional changes, welfare reforms and transformations in both Britain and Italy over the last three decades. The book illustrates that although it was a widely held belief in both countries that the arena of social and economic governance would shift to the national level, to the surprise of many, a different trend has emerged. In otherwise very different national experiences, both Britain and Italy have seen the sub-national level of governance become crucial in redefining public services, and in designing, delivering, and monitoring key services. The expert contributors use a distinctive and original principle – subsidiarity – as a lens through which to examine and assess these governance regimes, their philosophies, and their organizational choices. Academics, researchers and students of social policy, public policy, public administration and regional studies will find this book to be a highly fascinating read. It will also provide a wealth of information for policymakers and think tanks.

Available in PDF, EPUB and Kindle. Book excerpt: Money is the most frequently means used in the legal system to punish and regulate. Monetary penalties outnumber all other sanctions delivered by criminal justice in many jurisdictions, imprisonment included. More people pay fines than go to prison and in some jurisdictions many of those in prison are there because of failure to pay their fines. Therefore, it is surprising how little has been written in the Anglophone academic world about the nature of money sanctions and their specific characteristics as legal sanctions. In many ways, legal innovations related to money sanctions have been poorly understood. This book argues that they are a direct consequence of the changing meaning of money. Considering the ‘meaninglessness’ of modern money, the book aims to examine the history of changing conceptions in how fines have been conceived and used. Using a set of interpretative techniques sensitive to how money and freedom are perceived, the genealogy of the penal fine is presented as a story of constant reformulation in response to shifting political pressures and changes in intellectual developments that influenced ideological commitments of legislators and practitioners. This book is multi-disciplinary and will appeal to those engaged with criminology, sociology and philosophy of punishment, socio-legal studies, and criminal law.

Book excerpt: Disgorgement of profits is not exactly a household word in private law. Particularly in civil law jurisdictions – as opposed to those of the common law – the notion is not well known. What does it stand for? It is best illustrated by examples. One of the best known being the British case of Blake v Attorney General, [2001] 1 AC 268. In which a double spy had been imprisoned by the UK government before escaping and settling in the former Soviet Union. While there wrote a book on his experiences, upon which the UK government claimed the proceeds of the book. The House of Lords, as it then was, allowed the claim on the basis of Blake’s breach of his employment contract. Other examples are the infringement of intellectual property rights, where the damages of the owner are limited, but the profits of the wrongdoer immense. In such cases, the question arises whether the infringing party should be disgorged of his profits. This volume aims at establishing the notion of disgorgement of profits as a keyword in the discourse of private law. It does not purport to answer the question whether or not such damages should or should not be awarded. It does however aim to contribute to the discussion, the arguments in favour and against, and the organisation of the various actions.

Available in PDF, EPUB and Kindle. Book excerpt: Monetary law is essential to the functioning of private transactions and international dealings by the state: nearly every legal transaction has a monetary aspect. Money in the Western Legal Tradition presents the first comprehensive analysis of Western monetary law, covering the civil law and Anglo-American common law legal systems from the High Middle Ages up to the middle of the 20th century. Weaving a detailed tapestry of the changing concepts of money and private transactions throughout the ages, the contributors investigate the special contribution made by legal scholars and practitioners to our understanding of money and the laws that govern it. Divided in five parts, the book begins with the coin currency of the Middle Ages, moving through the invention of nominalism in the early modern period to cashless payment and the rise of the banking system and paper money, then charting the progression to fiat money in the modern era. Each part commences with an overview of the monetary environment for the historical period written by an economic historian or numismatist. These are followed by chapters describing the legal doctrines of each period in civil and common law. Each section contains examples of contemporary litigation or statute law which engages with the distinctive issues affecting the monetary law of the period. This interdisciplinary approach reveals the distinctive conception of money prevalent in each period, which either facilitated or hampered the implementation of economic policy and the operation of private transactions.

Book excerpt: The frequent attempts by companies to promote, intermediate and intercept individual conversations within digital communities are today opening up new ideological debate. In this work, our aim was to ascertain whether the new social ŇgameÓ is actually providing wealth for players, and examine any theoretical implications of the growing overlap between dialogue and sale, between market and society or, more simply, between money and gift. A review of recent literature is followed by discussion of logic and empirical evidence, which leads into a focus on the convergence currently taking place between the roles of customer and citizen. We develop a new theory of convergence and test it through a specially developed model of a Ňco-value chainÓ. The metrics of the Covalue Model are used to measure and clarify the roles of customers, companies and communities. The model is applied to a large number of recent case histories, providing a topical focus on implications for management.
