Basti pensare alla parallela disciplina dell'abuso del diritto e dell'elusione fiscale, cui viene dato ampio spazio nei commenti e alla dichiarata non punibilità di tali fenomeni, peraltro, già messa in discussione da alcune recentissime sentenze della Corte di Cassazione. Inoltre, vengono prese in considerazione le più recenti problematiche che riguardano i complessi rapporti tra la legge nazionale e le decisioni della Corte di Giustizia Europea, tra istanze di tutela sovranazionali e diritti costituzionalmente garantiti (temi quali il ne bis in idem, la prescrizione, i rapporti tra norme penali interne e la protezione degli interessi finanziari della UE).
