Benoît Camguilhem conteste d'emblée la primauté donnée à la victime et à son préjudice dans l'étude de la responsabilité sans faute. Il dénonce de manière pertinente l'éviction systématique du fait générateur en cas de rupture de l'égalité devant les charges publiques. L'auteur relève que la responsabilité n'est plus le mode exclusif de réparation des préjudices parce que l'imputation du fait générateur à une personne désignée comme responsable n'est plus exigée dans bien des hypothèses d'indemnisation. La responsabilité sans faute apparaît comme une catégorie négative, par laquelle sont rassemblées des hypothèses fort différentes qui n'ont d'autre point commun que l'absence d'exigence d'une faute à prouver. Si la responsabilité sans faute n'est rien d'autre qu'un mécanisme de responsabilité dans lequel la victime est dispensée de prouver la faute commise par la personne publique devant l'indemniser, cela signifie, inversement, que la responsabilité pour faute n'est rien d'autre qu'un mécanisme de responsabilité dans lequel la victime doit prouver la faute commise par la personne publique. En bref, si l'on écarte la considération de la preuve de la faute, la responsabilité ne peut avoir qu'un fondement unique. Ayant ainsi mis en lumière que le critère de distinction entre les deux régimes de responsabilité réside simplement dans l'exigence ou non, d'un point de vue contentieux, de la preuve d'une faute, Benoît Camguilhem en déduit, très audacieusement, que la notion même de faute peut être au fondement des deux régimes. Benoît Camguilhem établit donc que la responsabilité de la puissance publique jouit d'un seul et unique fondement, la méconnaissance d'une obligation préexistante. Mais dans certains cas, le juge estime devoir exiger la caractérisation de ce manquement comme fautif quand dans d'autres, pour diverses raisons non juridiques, il considère cette caractérisation inopportune. L'auteur peut en conclure, un brin provocateur, que la responsabilité sans faute n'existe pas.

Book excerpt: Against the background of the creation of an EU-wide frame of reference for private law relevant to the Common Market, this study, which was requested by the EU Commission, analyses the dovetailing between contract and tort law on the one hand, and between contract and property law on the other. The study examines the legal orders of almost all the Member States of the EU, illustrates the differences between contractual and non-contractual liability and evaluates the different systems of the transfer of property, of movable and immovable securities as well as trust law. The study comes to the conclusion that the intensive considerations on the creation of a model-law in the area of European private law do not allow these thoughts to be limited to contract law. Such a limitation to the scope of the regarding of this area would probably cause more problems than it would solve, or at any rate not do justice to the needs of the Common Market.
