L’originalité de ce travail réside précisément dans le fait que, classiquement, une responsabilité des ministres ne peut se concevoir que de façon collective, car les membres d’un gouvernement ne sont mis en cause, selon la Constitution du 4 octobre 1958, qu’à travers l’organe collectif et politique qu’est le gouvernement. Pourtant, sous la Vème République, un ministre est mis en cause à plusieurs reprises de façon individuelle et politique (puisqu’il est amené à quitter ses fonctions ministérielles), mais selon des règles émanant du droit pénal. En l’absence de responsabilité politique effective des gouvernants, l’encadrement juridique des différents aspects de la vie politique a eu pour conséquence de développer la responsabilité pénale pour les délits intentionnels ou non intentionnels. La responsabilité politique est un concept paradoxalement peu étudié en France, probablement parce que l’histoire politique française, tumultueuse du point de vue constitutionnel, n’a jamais donné l’occasion d’une véritable institutionnalisation de ce mécanisme original d’action des gouvernants et de contrôle des gouvernés. Alors qu’émerge aujourd’hui une vive demande sociale de responsabilité, la solution choisie de la responsabilité pénale des gouvernants n’apparaît pas satisfaisante et les arguments avancés par ceux qui la défendent (comme les gouvernants) témoignent d’une inquiétante méconnaissance à la fois des vertus du droit public classique et de la nécessité de conserver un statut particulier aux « représentants » de l’État.

De la Révolution française à la chute du Second Empire, la responsabilité pénale domine toute la responsabilité ministérielle et la responsabilité politique est rejetée tant en droit qu'en fait. Bien qu'elle soit constitutionnellement consacrée sous les Troisième et Quatrième Républiques, la responsabilité politique demeure inexistante en pratique. Dans la mesure où les deux Républiques se transforment en régime d'Assemblée, les ministres apparaissent davantage subordonnés à la volonté parlementaire que véritablement responsables devant les chambres. Alors qu'elle parvient – en partie – à résoudre les difficultés liées à la responsabilité pénale des ministres, la Cinquième République échoue à rendre effective la responsabilité gouvernementale devant l'Assemblée. Telle qu'elle est définie dans cette étude, la responsabilité politique des ministres demeure ainsi introuvable tout au long de l'histoire constitutionnelle française, à l'exception toutefois de la Cinquième République au cours de laquelle émerge une responsabilité non écrite des ministres devant le Président de la République

Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
