Su artículo 17 que es el que regula las respectivas responsabilidades, es el que ha generado una más abundante jurisprudencia y en él se fijan legalmente los criterios establecidos por la jurisprudencia a partir de la interpretación del Art. 1591 del Código Civil, constituyendo una importante novedad la regulación de tres plazos de garantía (de 10, 3 y 1 año, en relación a los diversos daños) pero sin derogar las otras responsabilidades legales y contractuales de que disponen los perjudicados. Por otra parte, en el ámbito judicial, son destacables las abundantes resoluciones judiciales encaminadas a determinar (a veces contradictoriamente) las consecuencias prácticas de la Disposición Adicional 7a que es la que permite al demandado pedir la llamada al pleito de los otros agentes que hayan intervenido en la edificación.
