This book was released on 2023 with total page 0 pages. Available in PDF, EPUB and Kindle. English AbstractTransnational enterprises have caused many difficulties in different legal contexts. The answer given by International Economic Law has demanded a reform in the paradigms of the legal field: from its subordination to financial concepts and its purpose in achieving economic progress to the adoption of the protection of human and fundamental rights as synonyms of development. The result is found in a series of domestic and international legal documents, which urge, besides States and international organizations, transnational corporations to the protection of those valuable rights. In these texts, it is encouraged self-regulation by the implementation of programs of compliance and its consequent elaboration of codes of ethics. However, the main obstacle to the adoption of these initiatives is their voluntary character. This article inquires how the self-regulation carried by corporate codes could enable the protection of human and fundamental rights, and, consequently, achieve the desired development. Thorough theoretical research, with a qualitative focus, this article postulates the employment of private international law equipped with principles. In reality, this legal field performs regulatory functions, common to public law, even though it is named private. Initially, it argues that conflict of laws would be applied in a macro dimension, to confer a legal nature to corporate codes, by allowing characterize them as contracts, sources of torts, a unilateral declaration or consumer relations. Furthermore, private international law would be applied in a micro dimension, with the purpose of allowing the dialogue between different codes of ethics or with other domestic legislations. Conflict of laws' principles adapts better to achievement of development, object of International Economic Law. It is, in summary, a new answer to Economic Law, which exceeds the limits of public and private: private tools as enterprises and codes of ethics are employed to archive Public Law ends.

Book excerpt: Latin America has been a complex laboratory for the development of international investment law. While some governments and non-state actors have remained true to the Latin American tradition of resistance towards the international investment law regime, other governments and actors have sought to accommodate said regime in the region. Consequently, a profusion of theories and doctrines, too often embedded in clashing narratives, has emerged. In Latin America, the practice of international investment law is the vivid amalgamation of the practice of governments sometimes resisting and sometimes welcoming mainstream approaches; the practice of lawyers assisting foreign investors from outside and within the region; and the practice of civil society, indigenous peoples and other actors in their struggle for human rights and sustainable development. Latin America and international investment law describes the complex roles that governments have played vis-à-vis foreign investors and investments; the refreshing but clashing forces that international organizations, corporations, civil society, and indigenous peoples have brought to the field; and the contribution that Latin America has made to the development of the theory and practice of international investment law, notably in fields in which the Latin American experience has been traumatic: human rights and sustainable development. Latin American scholars have been contributing to the theory of international investment law for over a century; resting on the shoulders of true giants, this volume aims at pushing this contribution a little further.

Book excerpt: The extractive sector is a particular area of expertise for Canada and more than half of Canada’s mining assets abroad are located in Latin America, specifically in Brazil, Peru, Chile, and Colombia. The Canada-Colombia accord was the first free-trade agreement in the world to include annual Human Rights Impact Assessments (HRIA), and also includes a labour side accord where abuse complaints can be formally registered. Using Colombia as a case study, James Rochlin and his international and multidisciplinary line up of Canadian and Colombian scholars, and activists working in the area of human rights, and the judiciary explore: What is the best way to identify and operationalize for mutual benefit the concentric space between the interests of extractive corporations in profit and security, on the one hand, and the interests of the host communities in the promotion of human rights and human security, on the other? What can the four emblematic and diverse cases in Colombia (Meta, Sergovia, Marmato, and Bolivar/La Guajira) tell us about how to fine tune and improve a newly implemented governmental HRIA to render it an increasingly useful global instrument to promote simultaneously corporate security and human security for host communities? What is the most efficient and effective way to design and implement Corporate Social Responsibility Programs in a manner that promotes simultaneously corporate security and community human security? Written in a clear and accessible style, Profits, Security, and Human Rights presents practical lessons on how to promote both corporate security and human security in communities where the extractive sector operates in the Global South.

Book excerpt: This volume analyses the most important problems and challenges that health, age and the environment introduce in the labour market, and how these factors affect both the way people work and their rights. The contributions here focus on the main challenges for social security systems, lawmakers and trade unions, and provide important solutions to improve workers’ rights and guarantee the viability of public social security systems. Other topics analysed here include dress-codes and whistleblowing in companies. From the labour point of view, workers’ representatives and trade unions must take action in collective bargaining to deal with these topics and adequately protect the workforce. The authors here are drawn from countries such as Hungary, Portugal, Spain, Italy, Poland, Brazil and Colombia, providing a global perspective. The book will appeal to lawyers, legal and human resources experts, economists, judges, academics and staff from trade unions and employers’ representation. The volume features insights and contributions in different languages, with chapters in Spanish (13), English (7) and Portuguese (2).
