Book excerpt: Con esta obra sobre La prueba en los procesos constitucionales de la profesora Ana Giacomette Ferrer, distinguida procesalista colombiana, fundadora y actual Presidenta del Centro Colombiano de Derecho Procesal Constitucional, se da inicio a la Coleccion sobre "Derecho Procesal Constitucional" del Centro de Estudios de Derecho Procesal Constitucional (CEDEPCO) de la Universidad Monteavila de Caracas, que edita la Editorial Juridica Venezolana. Se trata, por lo que respecta a la bibliografia editada en Venezuela, de la primera obra que aborda el tema de las pruebas ante la justicia constitucional, tanto con motivo del desarrollo de los procesos constitucionales de control de la constitucionalidad de las leyes, como de tutela o amparo a los derechos fundamentales. Aunque el libro esta referido al sistema colombiano de justicia constitucional, la forma como se ha tratado el tema tiene vigencia en todos los sistemas de justicia constitucional contemporaneos. El tema de las pruebas en los procesos constitucionales, por lo demas, es importantisimo, teniendo en cuenta que no solo las partes las pueden aportar y solicitar, sino que los jueces constitucionales deben decretarlas y practicarlas, incluso de oficio, dada la alta mision que tienen de garantizar la supremacia de la Constitucion, estandole vedada toda decision sobre temas de hecho, sin las necesarias e indispensables pruebas que han de constar en autos. Para tratar el tema, la profesora Giacomette, comienza su obra enmarcando conceptualmente la materia, tratando, en primer lugar, el tema de la relacion entre la "Jurisdiccion Constitucional" y el "Control Constitucional" refiriendose a sus origenes historicos en Colombia; y en segundo lugar, el tema de los modelos o tipologias de la justicia constitucional, para concluir, luego de analizar los controles de constitucionalidad difuso, concentrado y mixto, en que indudablemente el sistema colombiano, como el venezolano, encuadra en los denominados modelos mixtos. Con este marco, en tercer lugar, la autora trata lo que es la medula del libro, que es el tema de la prueba en los procesos de control constitucional, planteandose de entrada la discusion sobre si existe o no un esquema probatorio constitucional, para concluir en que por supuesto si existe, pasando luego a indagar, en la practica procesal de Colombia, y basandose en trabajo de campo, los diversos medios probatorios mas utilizados en los procesos de control constitucional. La obra concluye con una reflexion general sobre el tema de la decision del Juez Constitucional en materia probatoria.

Por todo ello, esta obra recopila la doctrina jurisprudencial más actual de los tres grandes Tribunales en relación a la prueba en el proceso penal, la interpretación que éstos hacen de las normas y su aplicación, incluyendo los acuerdos plenarios no jurisdiccionales del Tribunal Supremo, resultando muy útil en el ejercicio del Derecho.
