Il s'agit d'une analyse de droit comparé qui s'inscrit dans un cadre multidisciplinaire où le droit côtoie les sciences de l'environnement. La première section présente d'abord les différentes obligations exigées par le gouvernement provincial liées à la construction et au maintien des barrages et se penche ensuite sur la responsabilité juridique de leurs propriétaires quant aux dommages causés par la présence de ces ouvrages. Afin de mettre en perspective la réalité québécoise et ainsi mieux la comprendre, la seconde section aborde les lois fédérales américaines pertinentes à la certification des barrages. La troisième section analyse la problématique soulevée par ce mémoire à travers les principes du développement durable et de la gestion intégrée et concertée des ressources en eau. Cette analyse a permis de faire ce constat : le cadre juridique actuel de la gestion des barrages est loin de répondre à ces principes. Ce mémoire propose neuf recommandations, divisées en deux sujets : l'imposition de conditions à l'exploitation des barrages respectant une approche écosystémique et l'amélioration du processus d'attribution des autorisations afin qu'il prenne en compte la gestion intégrée et concertée des ressources en eau et les principes du développement durable.
