Sin embargo el rápido desarrollo que éstos han soportado en los últimos años ha provocado controversias jurídicas a las que el legislador todavía no ha dado respuestas. Tras un análisis del componente patrimonial de la propiedad intelectual, se dedican apartados especiales a las obras multimedia y las bases de datos, y se presta particular atención a las vulneraciones de los derechos de propiedad intelectual que tienen lugar a través de la red Internet. Entre los supuestos aquí estudiados cabe destacar la posible responsabilidad de los proveedores de servicios, los links, la utilización de imágenes, los buscadores de páginas web, el uso de filtros o los frames. La piratería intelectual constituye, también, uno de los aspectos básicos de la presente investigación, pues se trata de una práctica que ocasiona importantes pérdidas económicas para el creador intelectual. Se examinan, asimismo, los actuales sistemas de protección jurídica de los derechos de propiedad intelectual, penal y civil, y su viabilidad frente a las nuevas realidades tecnológicas de las que gozamos en la actualidad y a las que en el futuro se nos presenten.

New reforms must stem from a widespread and participatory debate, one of a common vision conceived for and by Peruvians. This book aims at making a technical and independent contribution to such debate; it summarizes the knowledge available about the challenges to be faced by the new administration. The study does not recommend silver bullets, but suggests policy options. It is based on the analysis of the current reality and in six decades of relationships with Peru, in which the Bank has implemented more than 100 projects and prepared more than 500 technical reports covering the wide range of development topics. When necessary, the study provides lessons that the Bank has learned elsewhere. The study provides a conceptual framework to the analysis of the country's 34 economic sectors and the two historical perspectives behind them.
