Les autorités politiques françaises après la décolonisation des années 60, ont voulu mettre en place un système de coopération, pensé par le général de Gaulle. En effet plus de cinq décennies après les indépendances octroyées par la France dans le cadre d'une coopération bilatérale multiforme, tant sur un plan politique, culturel, économique, financier et militaire, la France maintient toujours des relations étroites avec ses anciennes colonies. L'hypothèse généralement admise est celle d'une continuité de ces relations entre Paris et l'Afrique. On note en revanche depuis la fin de la guerre froide des signes de changements subtils mais réels dans plusieurs domaines. Beaucoup d'indices mettent en exergue la fin d'une époque et un changement de stratégie inévitable qui s'opère par une remise en cause totale de la politique traditionnelle de la France vis-à-vis de l'Afrique. Parmi ces changements, notons la réforme institutionnelle et politique de la coopération, le désengagement économique et financier progressif de la France. La politique africaine française est donc entrée dans une période de transition où les signes de changements interfèrent avec la continuité. En fait, il ne s'agit pas d'une nouvelle politique africaine, mais seulement de l'adoption d'un certain nombre de mesures nouvelles engendrées par la géopolitique du monde actuel.

Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
