Gelli-Bianco) e viene dato ampio conto del vivace dibattito, seguito ad un ambiguo accenno che la l. Balduzzi fa alla natura della responsabilità civile.Dopo aver ricordato i passaggi principali dei lavori preparatori l’Autore affronta gli aspetti penali della l. Gelli-Bianco – in particolare il nuovo art. 590 sexies c.p. - illustrando i termini del contrasto verificatosi all’interno della quarta sezione penale e analizzando la sentenza delle sezioni unite che tale contrasto ha risolto. Illustra poi le più rilevanti innovazioni introdotte nella disciplina civilistica della responsabilità sanitaria con particolare riferimento alla trasformazione in extracontrattuale di quella degli operatori da tali strutture dipendenti. Le sentenze di S. Martino offrono numerosi spunti di riflessione in tema - fra l’altro - di responsabilità sanitaria, onere della prova, perdita di chance, consenso informato e risarcimento del danno non patrimoniale. Le pronunce cercano di istituire un dialogo con la legge di riforma Gelli-Bianco e al contempo di sciogliere alcuni nodi interpretativi ancora rimasti in sospeso. In the mid-1970s, a reform movement started in the United States, where there was considerable concern about then ongoing medical malpractice crises. Since the beginning of the current century, France, Germany and Italy have passed statutes that aim to reform medical liability rules. Thus, it is first interesting to assess whether any medical malpractice crises have been identified in these systems and, second, how these have been faced through the passing of new statutes on the continent. Accordingly, the first chapter explores the idea of medical malpractice crisis and its relationship with the insurance market, also considering the reflections of American scholars. It then reconstructs the French, German and Italian legal frameworks, as well as their insurance and litigation contexts, reviewing and commenting on the quantitative evidence that was collected before the reforms. The second chapter briefly summarises the debate on medical malpractice reforms in France, Germany and Italy. It then analyses the statutes that have been passed, distinguishing between reforms that consolidate case law and reforms that introduce innovative solutions, sometimes repealing court-developed doctrines. In particular, the chapter examines in a comparative perspective the diff erent options adopted in these civil law countries with regard to the rules on liability, burden of proof, statute of limitations and damages. Moreover, the chapter examines the reforms of insurance, procedural and evidence law, to the extent they affect medical malpractice cases. The third chapter reviews and analyses the current available data related to medical malpractice litigation and insurance after the reforms adopted in France, Germany and Italy, in order to find out evidence of their effectiveness and efficiency. It also highlights some aspects of medical malpractice law that still belong to the domain of the judiciary. It finally points out which problems may be addressed by the legislatures and what further data should be collected in the future. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Consequently, the risk of disease outbreaks is also increasing. Actions to reduce the risk of disease should be considered a public health priority. This document provides guidance for managing water supplies in buildings where people may drink water; use water for food preparation; wash, shower, swim or use water for other recreational activities; or be exposed to aerosols produced by water-using devices, such as cooling towers. These uses occur in a variety of buildings, such as hospitals, schools, child and aged care, medical and dental facilities, hotels, apartment blocks, sport centres, commercial buildings and transport terminals. The target audience for this document includes the full range of "actors" who influence the overall safe management of building water supplies. In particular, it is directed at those who design, construct, manage, operate, maintain and regulate building water systems.
