Book Synopsis Information Obligations and Disinformation of Consumers by : Gert Straetmans
Download or read book Information Obligations and Disinformation of Consumers written by Gert Straetmans and published by Springer Nature. This book was released on 2019-09-05 with total page 565 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on recent developments in consumer law, specifically addressing mandatory disclosures and the topical problem of information overload. It provides a comparative analysis based on national reports from countries with common law and civil law traditions in Asia, America and Europe, and presents the reports in the form of chapters that have been drafted on the basis of a questionnaire, and which use the same structure as the questionnaire to allow them to be easily compared. The book starts with an analysis of the basic assumptions underlying the current consumer protection models and examines whether and how consumer models adapt to the new market conditions. The second part addresses the information obligations themselves, first highlighting the differences in the reported countries before narrowing the analysis down to countries with a general pre-contractual information duty, particularly the transparency requirements that often come with such a duty. The next part examines recent developments in the law on food labelling, commercial practices and unfair contract terms in order to identify whether similar traits can be found in European and non-European jurisdictions. The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. The final part provides a critical appraisal of the recent developments in consumer information obligations, addressing the question of whether the multiple criticisms from behavioural sciences necessitate abandonment or refinement of current consumer information models in favour of new, more adequate forms of consumer protection, and providing suggestions.
Book Synopsis Precarious Lives and Marginal Bodies in North Africa by : Hervé Anderson Tchumkam
Download or read book Precarious Lives and Marginal Bodies in North Africa written by Hervé Anderson Tchumkam and published by Rowman & Littlefield. This book was released on 2021-03-12 with total page 195 pages. Available in PDF, EPUB and Kindle. Book excerpt: Marginal Bodies and Precarious Lives in North Africa: Homo Expendibilis presents an examination of North African literature situated at the crossroads of literary analysis, political philosophy, and sociology. The author analyzes social categories in relation to civil and social protections and in particular, the ways in which disruptions to these protections can lead to social degeneration. The author’s analysis starts from the premise that precarious lives in North Africa have become true bodies of exception. In other words, they are deemed dangerous, expendable and unworthy of the rights and treatment accorded to full citizens. Thus, the author assesses portrayals of violence in contemporary literature as a crystallization of the existing disjunction between the socially disqualified and those who wield colonial, political, and religious power. Moreover, the author argues that in order to understand contemporary politics and the current climate of insecurity, a deeper understanding of precarity in North Africa from colonial times to the present is crucial. By affirming their right to exist, the author argues that the marginal bodies of North Africa offer unique insights into the society that marginalized them and thus, from the often inaudible and invisible periphery, they nevertheless challenge the dominant ideas of the center.
Book Synopsis Protecting Vulnerable Groups by : Francesca Ippolito
Download or read book Protecting Vulnerable Groups written by Francesca Ippolito and published by Bloomsbury Publishing. This book was released on 2015-04-30 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: The concept of vulnerability has not been unequivocally interpreted either in regional or in universal international legal instruments. This book analyses the work of the EU and the Council of Europe in ascertaining a clear framework or a set of criteria suitable to determine those who should be considered vulnerable and disadvantaged. It also explores the measures required to protect their human rights. Key questions can be answered by analysing the different methods used to determine the levels of protection offered by the two European systems. These questions include whether the Convention and the case law of the Strasbourg Court, the monitoring mechanisms of the Council of Europe, EU law and the case law of the European Court of Justice enhance the protection of vulnerable groups and expand the protection of their rights, or, alternatively, whether they are mainly used to fill in relatively minor gaps or occasional lapses in national rights guarantees. The analysis also shows the extent to which these two European systems provide analogous, or indeed divergent, standards and how any such divergence might be problematic in light of the EU accession to the European Convention on Human Rights.
Book Synopsis La nécessité en droit international by : Sarah Cassella
Download or read book La nécessité en droit international written by Sarah Cassella and published by BRILL. This book was released on 2011-05-06 with total page 591 pages. Available in PDF, EPUB and Kindle. This book analyses state of necessity through a new perspective: its function of limitation of international obligations. State practice shows that this mechanism is meant to avoid an excessive social cost, born out of a strict compliance with the law in a hard case.
Book Synopsis Enjeux européens et mondiaux de la protection des données personnelles by : Alain Grosjean
Download or read book Enjeux européens et mondiaux de la protection des données personnelles written by Alain Grosjean and published by Éditions Larcier. This book was released on 2016-02-10 with total page 367 pages. Available in PDF, EPUB and Kindle. Download or read book Jus et Societas written by G.M. Wilner and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 396 pages. Available in PDF, EPUB and Kindle. Book excerpt: When Wolfgang Friedmann died there was a great outpouring of grief, affection and admiration from his friends all over the world. These deeply felt sentiments were soon channelled into a number of projects to honor him. The initiative towards the preparation of this volume in tribute to Wolfgang Friedmann was taken by his colleague, Hans Smit, of Columbia University, who also arranged for its publication. Judge Philip C. Jessup was the chairman, and Professors John N. Hazard, Louis Henkin, Oliver Lissitzyn, Willis L. M. Reese and Hans Smit of Columbia University Law School, A. A. Fatouros of Indiana University Law School (Bloomington), and Gabriel M. Wilner of the University of Georgia Law School were members of the editorial committee. The authors of the essays are a group of distinguished legal scholars from many countries and who hold widely diverse views. All of them had many ties with Professor Friedmann, including those of friendship and shared interest in problems that were of the greatest concern to him. The number of eminent jurists from countries around the world, and particularly from the United States, who would have wished to participate in this tribute to Wolfgang Friedmann is large; however, several important considerations made it necessary to limit the number of contributions. Thus, for example, the work of several members of the editorial committee is not represented in the volume.
