Book excerpt: In October I873, as every Conference Report recalls, the Associ ation for the Reform and Codification of the Law of Nations was founded in Brussels (Belgium). At the Brussels Conference of I895 the Association's name was changed and ever since it has been "The International Law Association". On August 30 and 3I and September I, I973, a Centenary Cele bration will be held in the Association's place of birth. In the course of preparations made for this triduum, plans were also laid by the Executive Council for a Centenary Volume to mark the event. The formula adopted for the book was mostly based on contributions by Chairmen and/or Rapporteurs of International Committees of the Association who were asked to shed light on "the present state" of their subject. Hence the title of the Volume. For good measure, vari ous other topics not coming under the terms of reference of Inter national Committees were added. Almost all of the authors invited responded favourably, and their studies are to be found in Part II, arranged in sections which have no other justification than the Editor's whim. It should be pointed out that Chairmen and/or Rapporteurs of International Committees wrote their articles a titre personnel and, therefore, cannot be deemed to express opinions held by their Com mittees as such. Part I contains the "other essays", dealing with the Association itself rather than with the present state of international law.

In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

Il ne saurait donc être figé. En droit administratif, il est même de l'essence du contrat d'admettre des modifications aux conditions fixées initialement. La modification est au coeur du mécanisme contractuel qui est conçu comme un instrument de réalisation des objectifs de service public. Or depuis quelques années, ces principes classiques ont été remis en cause par l'extension des obligations de mise en concurrence venues limiter la liberté de l'Administration ou des parties de modifier leur contrat. Cette extension a deux conséquences. D'une part, elle détermine la notion de modification car elle délimite l'étendue de la modification. Au-delà d'un certain seuil, défini par le juge grâce aux critères de l'objet nouveau et du bouleversement de l'économie du contrat, la modification se transforme en nouveau contrat dont la passation doit faire l'objet d'une nouvelle mise en concurrence. Elle est donc jugée illégale car elle remet en cause les conditions initiales de la mise en concurrence. D'autre part, la réglementation rétroagit sur la mise en oeuvre de la modification en imposant des conditions de forme et de procédure similaires pour tous les instruments modificatifs. Quelle que soit son origine - unilatérale ou contractuelle - et quel que soit l'instrument utilisé pour la matérialiser (avenant, transaction, marché complémentaire, décision de poursuivre, ordre de service), la modification est encadrée par des contraintes extérieures à la volonté des parties résultant des principes de concurrence et de transparence. Dès lors, il n'y a plus lieu d'opposer les actes modificatifs unilatéraux aux actes modificatifs contractuels.
