Cette étude qualitative multicentrique (Isère et Savoie) réalisée auprès de vingt quatre acteurs de proximité, recrutés parmi des psychiatres, juges, patients et familles montre que cette loi n'est pas globalement remise en cause et qu'elle apporte des avantages pratiques : période d'observation, regard extérieur du juge, soins rapides aux personnes isolées en cas de péril imminent, amélioration des certificats ainsi que du suivi ambulatoire. Mais la loi du 5 juillet entraine aussi de nombreuses difficultés : les moyens manquent ; certaines parties du texte ne sont pas claires ; les audiences sont problématiques car précoces, publiques, et parfois réalisées en dehors des établissements hospitalier ; les possibilités de sorties d'essai de moyenne durée ont été abolies ; et les relations justice-psychiatrie sont complexes. Dix propositions ont pu être dégagées des entretiens et de leur analyse, afin d'améliorer la loi et les conditions de sa mise en œuvre. Ces recommandations relèvent de modifications législatives, de la création de dispositifs complémentaires innovants, d'actions de formations et de l'apport de moyens supplémentaires.

Computers and games may create supports for training or help people with cognitive, emotional, or behavioral change. Games take various formats, from board games to informatics to games with interactive rules of play. Similarly, computer tools may vary widely in format, from self-help or assisted computerized training to virtual reality or applications for smartphones. Some tools that may be helpful for mental health were specifically designed for that goal, whereas others were not. Gamification of computer-related products and games with a numeric format tend to reduce the gap between games and computers tools and increase the conceptual synergy in such fields. Games and computer design share an opportunity for creativity and innovation to help create, specifically design, and assess preventive or therapeutic tools. Computers and games share a design conception that allows innovative approaches to overcome barriers of the real world by creating their own rules. Yet, despite the potential interest in such tools to improve treatment of mental disorders and to help prevent them, the field remains understudied and information is under-disseminated in clinical practice. Some studies have shown, however, that there is potential interest and acceptability of tools that support various vehicles, rationales, objectives, and formats. These tools include traditional games (e.g., chess games), popular electronic games, board games, computer-based interventions specifically designed for psychotherapy or cognitive training, virtual reality, apps for smartphones, and so forth. Computers and games may offer a true opportunity to develop, assess, and disseminate new prevention and treatment tools for mental health and well-being. Currently, there is a strong need for state-of-the-art information to answer questions such as the following: Why develop such tools for mental health and well-being? What are the potential additions to traditional treatments? What are the best strategies or formats to improve the possible impact of these tools? Are such tools useful as a first treatment step? What is the potential of a hybrid model of care that combines traditional approaches with games and/or computers as tools? What games and applications have already been designed and studied? What is the evidence from previous studies? How can such tools be successfully designed for mental health and well-being? What is rewarding or attractive for patients in using such treatments? What are the worldwide developments in the field? Are some protocols under development? What are the barriers and challenges related to such developments? How can these tools be assessed, and how can the way that they work, and for whom, be measured? Are the potential benefits of such products specific, or can these additions be attributed to nonspecific factors? What are the users’ views on such tools? Its final achievement is to show that the lessons learned from the failure of the asylum led to the rise of psychoanalysis, an endeavor focused on individual care and on the cooperation between psychiatrist and patient. Cette dernière a pour objectif d’assurer le respect des droits des personnes hospitalisées en psychiatrie sans leur consentement et d’éviter les prises en charge abusives. Dans cette perspective, le législateur a imposé l’intervention du Juge des libertés et de la détention (JLD) pour garantir le renforcement des droits et la facilitation des démarches des personnes concernées. L’objectif de cette thèse est d’analyser le point de vue des JLD sur leurs pratiques en ce qui concerne les audiences relatives aux soins psychiatriques sans consentement. Méthode : une enquête qualitative a été réalisée auprès des JLD du Tribunal de Grande Instance (TGI) de Lille sous la forme d’un formulaire articulé autour de quatorze questions portant sur leurs pratiques usuelles. Résultats : trois JLD sur les quatre actuellement en activité ont répondu au questionnaire. Les résultats mettent en évidence des attentes précises des JLD sur de nombreux points dans les procédures de soins sans consentement : contenu des certificats médicaux, strict respect de la procédure imposée par la loi, déroulement de l’audience, accompagnement par un avocat et consentement du patient. Toutefois, certaines divergences apparaissent selon les magistrats, notamment sur l’importance de certains certificats médicaux et sur l’importance à apporter aux éléments recueillis au cours de l’audience en présence du patient. Enfin, il apparait également qu’au cours de leur formation, les JLD ne bénéficient que de programmes d’enseignement en psychiatrie très limités. Conclusion : les JLD représentent une figure influente dans les procédures de soins sans consentement en psychiatrie. Cette enquête, bien que menée sur un petit effectif, permet de mieux appréhender la place du JLD dans cette mesure et ainsi, de dégager des grands axes pour améliorer les pratiques des psychiatres en ce qui concerne les procédures de soins sans consentement.
