Book excerpt: Com’è noto, la legge n. 328 del 2000 è stata, insieme, sintesi e compimento di una riflessione che aveva coinvolto per decenni gli operatori così come gli amministratori pubblici e la dottrina giuridica circa il dover essere della disciplina degli interventi e dei servizi sociali. Com’è parimenti noto, peraltro, la legge n. 328, nata come una leggequadro è stata dopo poco per tale sua natura superata dalla riforma del Titolo V della Parte seconda della Costituzione. Tale riforma, infatti, nel ridefinire i rapporti tra legislazione statale e legislazione regionale ha implicitamente collocato la “materia” degli interventi e dei servizi sociali nell’area della competenza esclusiva regionale rendendo perciò concettualmente superata l’idea stessa di una legge-quadro a riguardo. È ben vero che dall’elenco degli ambiti di competenza esclusiva statale emergono importanti oggetti “trasversali” che non possono non riguardare anche gli interventi e i servizi sociali; si pensi alla “determinazione dei livelli essenziali delle prestazioni concernenti i diritti civili e sociali”. Ed è parimenti vero che per quell’importante retroterra cui si è accennato in apertura la legge n. 328 ha continuato ad essere anche al di là del suo peso formale un’ineludibile punto di riferimento dei legislatori regionali. Tuttavia, resta che la riforma del Titolo V ha definito un assetto della disciplina degli interventi e dei servizi sociali dove la legislazione regionale è destinata a porsi in primo piano, dove ben si può parlare della nascita di tanti ordinamenti regionali. Di conseguenza sul piano didattico si è manifestata un’insufficienza in linea di principio di una manualistica avente come baricentro la legge n. 328 con solo a margine cenni alla legislazione regionale. Questo è particolarmente vero se guardiamo alla Regione Lombardia dopo che questa nel 2008 si è finalmente avvalsa in misura significativa dei nuovi poteri conferiti alle regioni dalla Costituzione dando vita ad una propria, organica e in non piccola misura originale disciplina legislativa degli interventi e dei servizi sociali. Ecco allora la ratio di questo libro: proporre a fini didattici una riflessione sulla disciplina degli interventi e dei servizi sociali centrata sulla nuova legislazione lombarda ossia sul diritto effettivamente vigente nella maggiore regione italiana (una regione che, tra l’altro, storicamente è stata con la sua legislazione un punto di riferimento per le altre). Lo studio di questo libro si pone in termini di ideale completamento rispetto allo studio preliminare, comunque ineludibile, del “disegno” del sistema integrato degli interventi e servizi sociali come tratteggiato dalla legge n. 328. Il sistema delineato dalla recente legislazione lombarda non è radicalmente “altro” rispetto a quello di cui alla legge n. 328; c’è, ben al di là dei richiami formali, un’evidente continuità; di più, la legislazione regionale presuppone sostanzialmente la legge n. 328 al punto che il sistema regionale risulta indefinibile senza un riferimento alla legge n. 328. Nello stesso tempo, peraltro, la legislazione regionale lombarda vuole esprimere ed esprime una peculiare cultura politica anzitutto per quel che riguarda la collocazione dei “privati” nel sistema integrato degli interventi e dei servizi sociali. Studiarla porta ad entrare in un modo di concepire il servizio pubblico legato a quello della legge n. 328 e insieme nuovo. La riflessione si sviluppa nei termini brevi imposti dai limiti della didattica universitaria. Si tratta, potremmo dire, di una semplice introduzione. Tuttavia i nodi non sono sfumati in tranquillizzanti schematismi; si sfugge alla tentazione, cui sovente cedono i piccoli manuali, di proporre banali parafrasi. L’intenzione è quella di offrire un buon punto di partenza per “capire”. All’uso il compito di confermare l’adeguatezza dello strumento e di offrire spunti per migliorarlo.
