Book Synopsis National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law by : Anneli Albi
Download or read book National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law written by Anneli Albi and published by Springer. This book was released on 2019-05-29 with total page 1522 pages. Available in PDF, EPUB and Kindle. Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.

Book Synopsis The Foundations of Europe by : Thomas Hörber
Download or read book The Foundations of Europe written by Thomas Hörber and published by Springer Science & Business Media. This book was released on 2007-12-18 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thomas Hörber analyses the building process of European integration. He shows the parliamentary discourses of France, Germany and Britain to be representative of the national position of these states towards the developing concept of 'Europe'. He covers all key events and developments of the time which had an impact on the European integration process and provides an explanation for the convergence of national discourses towards a common Europe. This development was by no means a given and the analysis of parliamentary debates shows for the first time how vigorous the debates were on European integration in the 1950s, and how, despite setbacks (notably the failure of the European Defence Community), the discussion went in favour of integration.
Book Synopsis The Chinese Written Character as a Medium for Poetry by : Ernest Fenollosa
Download or read book The Chinese Written Character as a Medium for Poetry written by Ernest Fenollosa and published by Fordham Univ Press. This book was released on 2009-08-25 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1919 by Ezra Pound, Ernest Fenollosa’s essay on the Chinese written language has become one of the most often quoted statements in the history of American poetics. As edited by Pound, it presents a powerful conception of language that continues to shape our poetic and stylistic preferences: the idea that poems consist primarily of images; the idea that the sentence form with active verb mirrors relations of natural force. But previous editions of the essay represent Pound’s understanding—it is fair to say, his appropriation—of the text. Fenollosa’s manuscripts, in the Beinecke Library of Yale University, allow us to see this essay in a different light, as a document of early, sustained cultural interchange between North America and East Asia. Pound’s editing of the essay obscured two important features, here restored to view: Fenollosa’s encounter with Tendai Buddhism and Buddhist ontology, and his concern with the dimension of sound in Chinese poetry. This book is the definitive critical edition of Fenollosa’s important work. After a substantial Introduction, the text as edited by Pound is presented, together with his notes and plates. At the heart of the edition is the first full publication of the essay as Fenollosa wrote it, accompanied by the many diagrams, characters, and notes Fenollosa (and Pound) scrawled on the verso pages. Pound’s deletions, insertions, and alterations to Fenollosa’s sometimes ornate prose are meticulously captured, enabling readers to follow the quasi-dialogue between Fenollosa and his posthumous editor. Earlier drafts and related talks reveal the developmentof Fenollosa’s ideas about culture, poetry, and translation. Copious multilingual annotation is an important feature of the edition. This masterfully edited book will be an essential resource for scholars and poets and a starting point for a renewed discussion of the multiple sources of American modernist poetry.

Available in PDF, EPUB and Kindle. Book excerpt: The current economic crisis stems from a deeper crisis of cultural imagination and civilisational ethics: here is the starting point of this collection of essays which draw a new political economy facing the crisis of Western civilization. This bookgathers together a range of audacious and provocative readings of Caritas in Veritate, the first papal encyclical that addresses issues immediately relevant for politic, economic, and social theory. These readings embody the kind of fruitful dialogue Pope Benedict XVI wanted to generate with his radical discourse for an alternative political economy.

Book Synopsis Border as Method, or, the Multiplication of Labor by : Sandro Mezzadra
Download or read book Border as Method, or, the Multiplication of Labor written by Sandro Mezzadra and published by Duke University Press. This book was released on 2013-08-07 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: Far from creating a borderless world, contemporary globalization has generated a proliferation of borders. In Border as Method, Sandro Mezzadra and Brett Neilson chart this proliferation, investigating its implications for migratory movements, capitalist transformations, and political life. They explore the atmospheric violence that surrounds borderlands and border struggles across various geographical scales, illustrating their theoretical arguments with illuminating case studies drawn from Europe, Asia, the Pacific, the Americas, and elsewhere. Mezzadra and Neilson approach the border not only as a research object but also as an epistemic framework. Their use of the border as method enables new perspectives on the crisis and transformations of the nation-state, as well as powerful reassessments of political concepts such as citizenship and sovereignty.

Download or read book North Africa, Colonialism and the EU written by Volkan Ipek and published by Springer Nature. This book was released on 2019-11-28 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explains the postcolonial nationalism theory of Morocco focusing on the nation’s membership application to the European Economic Community (EEC) in 1987 through the initiatives of King Hassan II. The project examines why states, such as Morocco, that have been geographically beyond the classical European borders felt European in terms of self-identity. The author uses a comparative approach, studying Tunisia, Algeria, Malta, Cyprus, to postulate why these states have opted not to apply for EEC. This work brings a new approach to the Europe-Africa relations and revisits the concept of the European enlargement.
