Available in PDF, EPUB and Kindle.

Book Synopsis Mexico's Supreme Court by : Timothy M. James
Download or read book Mexico's Supreme Court written by Timothy M. James and published by UNM Press. This book was released on 2013-12-01 with total page 166 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although Mexico’s Constitution of 1917 mandated the division of large landholdings, provided land for the landless, and guaranteed workers the rights to organize, strike, and bargain collectively, it also guaranteed fundamental liberal rights to property and due process that enabled property owners and employers to resist the implementation of the new social rights by filing suit in federal court. Taking as its main focus the way new and old rights were adjudicated before the Supreme Court, this book is the first to examine the subject through the lens of court documents and the writings and commentaries of jurists and other legal professionals. The author asks and answers the question, how did the judicial interpretation of the Constitution of 1917 become a barrier to implementing agrarian land rights and labor legislation in the years immediately following Mexico’s social revolution of 1910?

Book Synopsis Monitoring Penal Policy in Europe by : Gaëtan Cliquennois
Download or read book Monitoring Penal Policy in Europe written by Gaëtan Cliquennois and published by Routledge. This book was released on 2017-10-30 with total page 179 pages. Available in PDF, EPUB and Kindle. Book excerpt: The process of judicial control over institutions is often described as growing socio-legal trend which impacts the development of modern societies. This is particularly the case for prisons and other penal institutions, as international bodies and the courts have tried to influence prison policies since the 1960s. This book addresses this dynamic situation by focusing on European monitoring as a major influence on penal and prison policies within, between and across nation states. Bringing together experts from around Europe, this book actively contributes to debates and analysis within penal and prison policy studies by shedding lights on the impacts of monitoring, and demonstrates how the study of penal and prison reform in different European countries can contribute to building a clearer and more precise picture of European legal systems. This book will be of interest to researchers in the fields of prisons, penology and punishment, as well as policymakers and professionals working for national Ministries of Justice and for prison department and national human rights institutions, as well as those working for INGOs and NGOs.
Book Synopsis Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU by : Alejandro Hernández López
Download or read book Conflicts of Criminal Jurisdiction and Transfer of Proceedings in the EU written by Alejandro Hernández López and published by Springer Nature. This book was released on 2022-11-21 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: Framework Decision 2009/948/JHA on the prevention and settlement of conflicts of exercise of jurisdiction in criminal proceedings established an ad hoc procedure for settling conflicts of criminal jurisdiction based on the mutual exchange of information and the establishment of direct consultations between the competent authorities with a view to reaching consensus on an effective solution. However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the various principles and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined. After discussing the main principles and fundamental rights at stake, the author proposes two alternative and original de lege ferenda models for the prevention and settlement of conflicts of criminal jurisdiction and transfer of criminal proceedings, exploring the different possibilities offered by the EU’s primary law.
