El ejercicio, el reconocimiento y la propia tutela jurídica de los derechos de conflicto y acción colectiva directa presentan en el nivel internacional y transnacional perfiles y dificultades propias que hacen que su tratamiento sea aún más complejo que el de la negociación colectiva transnacional, siendo así que en este ámbito su interrelación es aún más notoria. Si el planteamiento de conflictos colectivos presenta ya una regulación y una defensa compleja dentro del ámbito nacional, cuando el conflicto laboral traspasa las fronteras de un Estado la diferencia en la regulación jurídica, los conceptos de orden público laboral y norma de policía y la inexistencia de una norma de conflicto clara no son los únicos problemas a los que se enfrentan los sindicatos de trabajadores: la primera dificultad es el propio planteamiento del conflicto y la organización y movilización de los trabajadores, que requiere en este ámbito de una coordinación sindical global y unos medios de acción más creativos.La conflictividad laboral internacional está unida a la globalización de la actividad productiva y por ello debe ser facilitada y normativamente tratada también a un nivel internacional. La ausencia de competencia legislativa de la Unión Europea no ha hecho más que introducir un nivel más de dificultad, pero el adecuado reconocimiento a nivel internacional y regional europeo del derecho de huelga y el desarrollo de la negociación colectiva transnacional y sus mecanismos de refuerzo y solución de conflictos contribuyen a dotar a los trabajadores y a los sindicatos globales de herramientas y mecanismos, fundamentalmente de autocomposición, que pueden frenar la pérdida de derechos laborales y la «carrera hacia el fondo» que el predominio del poder económico y el deficiente tratamiento jurídico de la huelga transnacional generan.En esta obra se lleva a cabo un estudio del planteamiento, desarrollo y solución de los conflictos colectivos de trabajo en el ámbito transnacional, desde el marco jurídico y económico de referencia al análisis de los mecanismos de los que se dispone para lograr una solución que suponga la mejora de las condiciones de vida y trabajo de las personas trabajadoras, analizando las reglas de acceso a los tribunales de justicia y los medios de autocomposición y solución negociada de la discrepancia.

The first is that early years education has matured to the point that pedagogical and regulatory frameworks have been introduced and linked to a terminology of professionalism. The questioning leads to the second argument: the need for a new future for early years education marked by a ‘critical ecology’ of the profession. In exploring the issues, this book begins by recording in detail the daily work of early years educators from six countries: Australia, England, Finland, Germany, New Zealand and Sweden.
