Esta investigación, realizada desde una perspectiva técnica y conforme al Anexo 13 del Convenio de Chicago, no siempre ha contemplado de manera eficaz su conexión o coordinación con la Administración de Justicia, en especial con un eventual proceso penal. En los últimos años se ha producido un incremento de la criminalización de estos sucesos, a pesar de la extraordinaria seguridad alcanzada por este sistema de transporte, en gran medida gracias a estos mecanismos de investigación técnicos de accidentes. Ello ha dado lugar a una creciente discusión acerca de cómo deben ser las relaciones entre dos instrumentos de la sociedad, que si bien persiguen directa o indirectamente el mismo fin, evitar la reiteración de futuros accidentes, son incompatibles en sus principios y métodos. Dicha coordinación presenta retos y complejidades de gran trascendencia para la seguridad aérea y para las actuaciones de los profesionales y empresas del sector. El presente trabajo los afronta analizando la normativa y los protocolos de cooperación alcanzados en otros países. Ya en España, se proponen actuaciones concretas para la coordinación de ambas investigaciones. Se analiza también el régimen de protección de la información obtenida en el contexto de dicha investigación, como es el caso de las grabaciones contenidas en las llamadas «cajas negras», y su posible eficacia probatoria una vez incorporada a un eventual proceso penal. Con ello los juristas y profesionales del sector encontrarán sin duda material para una reflexión de cara a la próxima revisión del Reglamento (UE) 996/2010, de 20 de octubre, sobre investigación de accidentes e incidentes aéreos graves, prevista en el propio texto para diciembre de 2014 y para la elaboración de Protocolos de coordinación en España, en cumplimiento de la Disposición adicional novena de la Ley de Seguridad Aérea.
