Estas innovaciones mejoran la gobernanza económica interna de la Unión Europea, pero aún quedan pendientes importantes reformas para lograr una Unión Económica y Monetaria eficiente. La profundización económica, que no ha avanzado en paralelo con la revisión de los Tratados, presenta importantes tensiones para el modelo político de la Unión Europea, como consecuencia de la diferenciación creciente entre Estados miembros de la Eurozona y los que no lo son, y va a requerir importantes cambios en la política europea para responder a los requerimientos de legitimidad política. En segundo lugar, se ha analizado el avance o retroceso de la UE en la escena internacional como consecuencia de la puesta en marcha de las innovaciones del Tratado de Lisboa y del contexto de la crisis. Se constata que con las nuevas instituciones del Alto Representante para la Política Exterior y el Servicio Europeo de Acción Exterior ha mejorado sustancialmente la gestión de la política exterior, y en algunos casos, incluso, la formulación. Se ha estudiado además el impacto de la acción de la UE en distintas instancias internacionales en tiempos de crisis, constatándose algunos avances en la reforma de las instituciones internacionales a través del G20. En paralelo se constata un incremento de la unidad de la posición europea en las Naciones Unidas en relación con la cuestión de los Derechos Humanos así como también un relevante protagonismo, prácticamente hegemónico, en las Conferencias Internacionales de codificación del Derecho internacional privado.

As the world looks for an exit from this economic crisis – the worst in eight decades – the focus of attention is naturally on the causes, the factors that account for its wide reach and severity, as well as on strategies that might bring it to a closure. The quest for exit strategies is at the very centre of the issues and concerns explored in the present volume, produced by the IIAS. Like the preceding volumes, but even more emphatically, this volume, representing a collective endeavour of scholars and practitioners from many parts of the globe, finds cause to lay the blame, for our difficult predicament, on the institutional deficit, the policies, the practices and values that have followed in the trail of a highly misleading and erroneous model of governance. Looking for exit strategies, as its title aptly suggests, the present volume offers a rich menu of ideas drawn from the current experience of all the world ́s main regions. Not surprisingly, two concepts stand out throughout the book as necessary correctives, as well as pressing remedies to the world ́s ongoing malaise. They call for the recapture of our common administrative space and the reaffirmation of the values and virtues appropriate for democratic governance. To the IIAS, none perhaps are more important than public service professionalism and none other can contribute more effectively to the reform and consolidation of sound institutions for national, sub national, global and regional governance. Book excerpt: This book analyses a selection of challenges in the implementation and application of the 1982 UN Convention on the Law of the Sea (UNCLOS), focusing on several areas: international organizations, fisheries, security, preserving marine biodiversity, dispute settlement, and interaction with other areas of international law. UNCLOS has been described as the Constitution for the Oceans. It sets out the fundamental rights, obligations and jurisdictions of States regarding the access to, uses and management of the oceans and seas and their resources. It balances States’ diverse and sometimes conflicting interests, such as conflicting uses of space, against navigational interests and the protection of the marine environment. UNCLOS is the first global treaty to include comprehensive obligations on the protection and preservation of the marine environment, including the conservation of living marine resources. These are often common or cross-border challenges, which can only be addressed through international cooperation. The book is divided into three thematic parts. The first concerns the role of international organizations in ocean governance. It includes twelve chapters covering a very diverse set of issues, both materially and geographically, that demonstrate the importance of coordinated actions on the part of multiple States for obtaining harmonized solutions regarding the pursuit of activities in maritime spaces (in connection with e.g. navigation, fisheries or maritime security). The second part concerns the relevance of dispute settlement mechanisms for understanding the international law of the sea and the international legal framework within which the actions of the great maritime powers take place. It is composed of three chapters, examining stakeholders’ role in dispute settlement, the position taken by China and the Russian Federation regarding international litigation in maritime spaces, and how the South China Sea Award may be relevant to the debate on the international legal concepts of rock and island. In turn, the third part addresses current discussions on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction. Its seven chapters report on the status quo of the ongoing negotiations for a new international legal regime of the high seas, and the establishment and operationalization of environmental regimes for international maritime spaces.
