Book excerpt: Notre recherche nous amène à nous intéresser à la détermination de la peine et à la manière dont les juges mobilisent, à ce stade des procédures, les inputs des victimes qui y sont fréquemment observées. À la fin des années 1980, le rôle de la victime dans les procédures judiciaires s'est étendu de la victime-témoin de l'acte (témoin traditionnel) à celui de la victime-témoin de l'impact. Le contexte théorique de cette recherche est celui d'une combinaison de la théorie des systèmes autoréférentiels de Niklas Luhmann et de la théorie de la rationalité pénale moderne d'Alvaro P. Pires. Le système judiciaire, désignant ici les tribunaux ayant compétence en matière criminelle et pénale, est compris comme un système opérationnellement clos sur lui-même, mais cognitivement ouvert sur son environ-nement (Luhmann, 1992). À l'intérieur de ce cadre théorique, l'ouverture cognitive du système judiciaire, au moment de déterminer la peine, est structurellement déterminée par les théories de la peine formant le système d'idée de la rationalité pénale moderne (RPM) (Pires, 2008). La relation que le système judiciaire développe avec les victimes d'actes criminels serait alors soumise hypothétiquement à l'influence de cette rationalité juridique. Ainsi, plutôt que de voir les victimes comme étant hostiles en elles-mêmes, nous voulons explorer l'influence du système dans la sélection et la mise en forme d'un discours victimaire répressif.

Dans une société que d’aucuns qualifient de victimisation permanente, de telles réflexions sont plus que jamais nécessaires, la montée en puissance de la victime dans le droit criminel reflétant sans doute quelque part celle de la peur dans la société contemporaine.

Elle se fixe un horizon de pacification pénale et non plus d'exemplarité sociale. Elle souhaite l'apaisement et l'équilibre sociétal, au détriment des intérêts de la victime et de l'Etat mais au bénéfice du condamné. Pour être moins injuste, mieux adaptée aux évolutions polymorphes de la criminalité, la Justice pénale s'oriente vers plus de contractualité et moins de judiciarité. Pour être plus juste, elle s'appuie sur des peines de nouvelle génération, négociées et non plus imposées. En suivant une via nova et moderna de pacification pénale, elle souhaite éradiquer les infractions de basse ou de moyenne intensité. Ancrée dans la dynamique pénale du XXIe siècle, la Justice pénale ambitionne d'être de moins en moins injuste.

The body of mortal creatures, the body politic, the body of letters and of laws, the “mystical body of Christ”—all these (and others) are incorporated in the word Corpus, the title and topic of Jean-Luc Nancy’s masterwork. Corpus is a work of literary force at once phenomenological, sociological, theological, and philosophical in its multiple orientations and approaches. In thirty-six brief sections, Nancy offers us at once an encyclopedia and a polemical program—reviewing classical takes on the “corpus” from Plato, Aristotle, and Saint Paul to Descartes, Hegel, Husserl, and Freud, while demonstrating that the mutations (technological, biological, and political) of our own culture have given rise to the need for a new understanding of the body. He not only tells the story of this cultural change but also explores the promise and responsibilities that such a new understanding entails. The long-awaited English translation is a bold, bravura rendering. Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.

He recovers the potent anti-Jewish, anticapitalist propaganda that cemented the idea of a Jewish conspiracy in the European mind and connects it to the atrocities that characterized the Jewish experience in the nineteenth and twentieth centuries. Beginning in the eighteenth century, counter-Enlightenment intellectuals and intransigent Catholic writers singled out Jews for conspiring to exploit self-sustaining markets and the liberal state. These ideas spread among socialist and labor movements in the nineteenth century and intensified during the Long Depression of the 1870s. Anti-Jewish anticapitalism then migrated to the Habsburg Empire with the Christian Social Party; to Germany with the Anti-Semitic Leagues; to France with the nationalist movements; and to Italy, where Revolutionary Syndicalists made anti-Jewish anticapitalism the basis of an alliance with the nationalists. Exemplified best in the Protocols of the Elders of Zion, the infamous document that "leaked" Jewish plans to conquer the world, the Jewish-conspiracy myth inverts reality and creates a perverse relationship to historical and judicial truth. Isolating the intellectual roots of this phenomenon and its contemporary resonances, Battini shows us why, so many decades after the Holocaust, Jewish people continue to be a powerful political target.

Censorship was abolished, and France appeared to be on a path towards tolerance, pluralism, and civil liberties. A mere four years later, the country descended into a period of political terror, as thousands were arrested, tried, and executed for crimes of expression and opinion. In Policing Public Opinion in the French Revolution, Charles Walton traces the origins of this reversal back to the Old Regime. He shows that while early advocates of press freedom sought to abolish pre-publication censorship, the majority still firmly believed injurious speech--or calumny--constituted a crime, even treason if it undermined the honor of sovereign authority or sacred collective values, such as religion and civic spirit. With the collapse of institutions responsible for regulating honor and morality in 1789, calumny proliferated, as did obsessions with it. Drawing on wide-ranging sources, from National Assembly debates to local police archives, Walton shows how struggles to set legal and moral limits on free speech led to the radicalization of politics, and eventually to the brutal liquidation of "calumniators" and fanatical efforts to rebuild society's moral foundation during the Terror of 1793-1794. With its emphasis on how revolutionaries drew upon cultural and political legacies of the Old Regime, this study sheds new light on the origins of the Terror and the French Revolution, as well as the history of free expression.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
