La présente thèse s'efforce tout d'abord de définir le concept même de « minorité religieuse », en étudiant la diversité des situations, en s'interrogeant sur l'applicabilité des critères de la « minorité » (nombre, domination) et en questionnant l'impact que la sécularisation de certaines sociétés d'une part, et les migrations liées à la mondialisation d'autre part, peuvent avoir sur la définition de la « minorité religieuse ». La thèse se penche, ensuite, sur les régimes qui ont pu s'appliquer dans le passé aux minorités religieuses, puis sur les normes en vigueur qui peuvent servir à les situer juridiquement. Elle se termine par l'identification de règles concrètes qui pourraient assurer un meilleur équilibre entre une pleine liberté religieuse et l'ordre public des sociétés concernées.

Over the last few decades many initiatives have been launched by Muslim communities in the European Union to create infrastructural provisions for their religious life, within the existing legal and social frameworks. In fact, all countries of the European Union share the principles of religious freedom and non-discrimination in their respective Constitutions. However, the precise way in which these principles are interpreted and applied to Islam depends largely on the historical traditions concerning the relation between State and Religion, which differ from one country to another. These differences are reflected in recent developments in the communication between the States and their Muslim communities, both at national, regional and municipal levels. They are also reflected in recent developments in legislation and jurisprudence concerning the most essential Islamic core-values, such as dietary laws, the precepts on modest dress, Islamic burial practices and the possibilities to found Islamic cemeteries, as well as the observance of Friday prayers and annual holidays. Looking at the legal position of Islam in the countries of the European Union, the authors of this volume discuss the challenges posed by the presence of Islam to the Western European system of relationships between law and religion. They argue, that these challenges necessitate reforms within the relevant European legislation, but differ as to their precise nature. They also discuss the difficulties of this task, as these adjustments will alter a longstanding balance of rights and privileges recognised by different religious denominations. Legal reforms, however, are not sufficient. The creation of a truly multicultural Europe also necessitates fighting against the negative image of Islam and Muslims (anti-Muslimism or Islamophobia) prevailing in most of its member states.

Isolated instances of influence have been examined in detail, but the historical and still ongoing processes of mutual interaction have rarely been seriously considered. The ruling assumption has been that Germany may have an impact on Turkey, but not the other way around. Religion, Identity and Politics examines this mutual interaction, specifically with regard to religious identities and institutions. It opposes the commonly held assumption that Europe is the abode of secularism and enlightenment, while the lands of Islam are the realm of backwardness and fundamentalism. Both historically and contemporarily, Germany has treated religion as a core aspect of communal and civilizational identity and framed its institutions accordingly; the book explores how there has been, and continues to be, a mutual exchange in this regard between Germany and both the Ottoman Empire and modern Turkey. The authors show that the definition of identity and regulation of communities have been explicitly based on religion until the early and since the late twentieth century; the period in between– the age of secular nationalism– which has always been treated as the norm, now appears more clearly as an exception. Sa signification théorique et politique dans l’Union est débattue par les auteurs, autant que son devenir. Loin de demeurer fragmentaire à côté des droits nationaux des États membres, il a probablement vocation à se densifier pour offrir aux citoyens et résidents européens un droit commun de la famille au sein de l’Union. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.
