In a context of increasing polarization of public opinion about religious questions, how do issues involving religion appear in France, the United States, Belgium, and Canada? Parliamentary commissions, governmental reports, and laws pertaining to Islam and to so-called sects often lead to the promulgation of regulations that reflect the public's anxiety that religious diversity per se is threatening. The purpose of this book is to examine some of the identities, values, images, and myths that are perceived by decision makers and by participants in civil societies when boundaries are drawn between the public and the religious at the place where globalization and universal human rights meet.

Available in PDF, EPUB and Kindle. Book excerpt: The permanent presence of Islam and Muslims is a comparatively recent phenomenon in most countries of the European Union. Over the last few decades many initiatives have been launched by Muslim communities in the European Union to create infrastructural provisions for their religious life, within the existing legal and social frameworks. In fact, all countries of the European Union share the principles of religious freedom and non-discrimination in their respective Constitutions. However, the precise way in which these principles are interpreted and applied to Islam depends largely on the historical traditions concerning the relation between State and Religion, which differ from one country to another. These differences are reflected in recent developments in the communication between the States and their Muslim communities, both at national, regional and municipal levels. They are also reflected in recent developments in legislation and jurisprudence concerning the most essential Islamic core-values, such as dietary laws, the precepts on modest dress, Islamic burial practices and the possibilities to found Islamic cemeteries, as well as the observance of Friday prayers and annual holidays. Looking at the legal position of Islam in the countries of the European Union, the authors of this volume discuss the challenges posed by the presence of Islam to the Western European system of relationships between law and religion. They argue, that these challenges necessitate reforms within the relevant European legislation, but differ as to their precise nature. They also discuss the difficulties of this task, as these adjustments will alter a longstanding balance of rights and privileges recognised by different religious denominations. Legal reforms, however, are not sufficient. The creation of a truly multicultural Europe also necessitates fighting against the negative image of Islam and Muslims (anti-Muslimism or Islamophobia) prevailing in most of its member states.

Available in PDF, EPUB and Kindle. Book excerpt: German–Turkish relations, which have a long history and generally unrecognized depth, have rarely been examined as mutually formative processes. Isolated instances of influence have been examined in detail, but the historical and still ongoing processes of mutual interaction have rarely been seriously considered. The ruling assumption has been that Germany may have an impact on Turkey, but not the other way around. Religion, Identity and Politics examines this mutual interaction, specifically with regard to religious identities and institutions. It opposes the commonly held assumption that Europe is the abode of secularism and enlightenment, while the lands of Islam are the realm of backwardness and fundamentalism. Both historically and contemporarily, Germany has treated religion as a core aspect of communal and civilizational identity and framed its institutions accordingly; the book explores how there has been, and continues to be, a mutual exchange in this regard between Germany and both the Ottoman Empire and modern Turkey. The authors show that the definition of identity and regulation of communities have been explicitly based on religion until the early and since the late twentieth century; the period in between– the age of secular nationalism– which has always been treated as the norm, now appears more clearly as an exception. This book will be of interest to students and scholars of sociology, politics, history and religion.

This book was released on 2020-12-31 with total page 409 pages. Available in PDF, EPUB and Kindle. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.
