Available in PDF, EPUB and Kindle. Book excerpt: Even though youth crime rates have fallen since the mid-1990s, public fear and political rhetoric over the issue have heightened. The Columbine shootings and other sensational incidents add to the furor. Often overlooked are the underlying problems of child poverty, social disadvantage, and the pitfalls inherent to adolescent decisionmaking that contribute to youth crime. From a policy standpoint, adolescent offenders are caught in the crossfire between nurturance of youth and punishment of criminals, between rehabilitation and "get tough" pronouncements. In the midst of this emotional debate, the National Research Council's Panel on Juvenile Crime steps forward with an authoritative review of the best available data and analysis. Juvenile Crime, Juvenile Justice presents recommendations for addressing the many aspects of America's youth crime problem. This timely release discusses patterns and trends in crimes by children and adolescentsâ€"trends revealed by arrest data, victim reports, and other sources; youth crime within general crime; and race and sex disparities. The book explores desistanceâ€"the probability that delinquency or criminal activities decrease with ageâ€"and evaluates different approaches to predicting future crime rates. Why do young people turn to delinquency? Juvenile Crime, Juvenile Justice presents what we know and what we urgently need to find out about contributing factors, ranging from prenatal care, differences in temperament, and family influences to the role of peer relationships, the impact of the school policies toward delinquency, and the broader influences of the neighborhood and community. Equally important, this book examines a range of solutions: Prevention and intervention efforts directed to individuals, peer groups, and families, as well as day care-, school- and community-based initiatives. Intervention within the juvenile justice system. Role of the police. Processing and detention of youth offenders. Transferring youths to the adult judicial system. Residential placement of juveniles. The book includes background on the American juvenile court system, useful comparisons with the juvenile justice systems of other nations, and other important information for assessing this problem.

Book excerpt: This is an independent sample of juvenile defendants drawn from the State Court Processing Statistics (SCPS) for 1998 (see ICPSR 2038). SCPS 1998 tracked felony cases filed in May 1998 until final disposition or until one year had elapsed from the date of filing. SCPS 1998 presents data on felony cases filed in approximately 40 of the nation's 75 most populous counties in 1998. These 75 counties account for more than a third of the United States population and approximately half of all reported crimes. The cases from these 40 jurisdictions were weighted to represent all felony filings during the month of May in the 75 most populous counties. Data were collected on arrest charges, demographic characteristics, criminal history, pretrial release and detention, adjudication, and sentencing. Within each sampled site, data were gathered on each juvenile felony case. Cases were tracked through adjudication or for up to one year. The source used to identify the upper age for juveniles and the filing mechanism appropriate to each state was the OJJDP publication, Trying Juveniles as Adults in Criminal Court : An Analysis of State Transfer Provisions (December 1998) ... Available in PDF, EPUB and Kindle. Book excerpt: Adolescence is a distinct, yet transient, period of development between childhood and adulthood characterized by increased experimentation and risk-taking, a tendency to discount long-term consequences, and heightened sensitivity to peers and other social influences. A key function of adolescence is developing an integrated sense of self, including individualization, separation from parents, and personal identity. Experimentation and novelty-seeking behavior, such as alcohol and drug use, unsafe sex, and reckless driving, are thought to serve a number of adaptive functions despite their risks. Research indicates that for most youth, the period of risky experimentation does not extend beyond adolescence, ceasing as identity becomes settled with maturity. Much adolescent involvement in criminal activity is part of the normal developmental process of identity formation and most adolescents will mature out of these tendencies. Evidence of significant changes in brain structure and function during adolescence strongly suggests that these cognitive tendencies characteristic of adolescents are associated with biological immaturity of the brain and with an imbalance among developing brain systems. This imbalance model implies dual systems: one involved in cognitive and behavioral control and one involved in socio-emotional processes. Accordingly adolescents lack mature capacity for self-regulations because the brain system that influences pleasure-seeking and emotional reactivity develops more rapidly than the brain system that supports self-control. This knowledge of adolescent development has underscored important differences between adults and adolescents with direct bearing on the design and operation of the justice system, raising doubts about the core assumptions driving the criminalization of juvenile justice policy in the late decades of the 20th century. It was in this context that the Office of Juvenile Justice and Delinquency Prevention (OJJDP) asked the National Research Council to convene a committee to conduct a study of juvenile justice reform. The goal of Reforming Juvenile Justice: A Developmental Approach was to review recent advances in behavioral and neuroscience research and draw out the implications of this knowledge for juvenile justice reform, to assess the new generation of reform activities occurring in the United States, and to assess the performance of OJJDP in carrying out its statutory mission as well as its potential role in supporting scientifically based reform efforts.

Available in PDF, EPUB and Kindle. Book excerpt: A separate juvenile justice system was established in the United States in 1899 with a goal of diverting juvenile offenders from the harsh punishments of the adult criminal court, and encouraging rehabilitation based on the individual needs of the offender. This new juvenile court was set up as a civil or chancery court with informal proceedings and discretion left to the juvenile court judge. Furthermore, juvenile court proceedings were closed to the public and juvenile records were to remain confidential. However, as the decades progressed juveniles became increasingly involved in more serious crimes. This generated a growing fear among lawmakers, educators, and the public which resulted in a number of “get tough” policies and strategies. By the 1990s the most popular approach in dealing with violent juvenile crime was for states to make it easier or to require the prosecution of juveniles as adults in criminal court. Research demonstrates that such policies may be counter-productive, increase rather than decrease recidivism, and cause harm to offenders, their families, and the community. This volume provides a comprehensive historical review of knowledge surrounding the transfer of American’s youth from the rehabilitative, individualized treatment of the juvenile justice system to the adult criminal justice system.

Book excerpt: "Despite being labeled as adults, the approximately 200,000 youth under the age of 18 who are now prosecuted as adults each year in criminal court are still adolescents, and the contradiction of their legal labeling creates numerous problems and challenges. In Courting Kids, Carla J. Barrett takes us behind the scenes of a unique judicial experiment called the Manhattan Youth Part, a specialized criminal court set aside for youth prosecuted as adults in New York City. Focusing on the lives of those coming through and working in the courtroom, Barrett's study reflects the costs, challenges, and consequences the 'tough on crime' age has had, especially for young men of color. Through observation, interviews, and the construction of 'court narratives' that trace several kids through the progression of their cases, Barrett shows how members of the court worked to develop a humanizing model of justice cognizant of the often difficult realities of adolescent lives. Skillfully engaging with some of the most critical issues facing our justice system today, from routine judicial practices to the appropriate legal responses to serious adolescent transgression, Courting Kids is a compelling study of the law in action"--Unedited summary for book cover

Book excerpt: Juvenile delinquency and juvenile justice are two essential topics in the criminal justice curriculum. Sanborn and Salerno's The Juvenile Justice System: Law And Process is dedicated solely to explaining juvenile justice. This text explores the many differences between the juvenile justice and the criminal justice systems, both those that benefit youths and those that are arguably unfair to them. The book concentrates, describes, and explains the unique traits of juvenile justice and what makes it so different from criminal justice. The Juvenile Justice System specifically addresses what actually happens during the court process, devoting an entire chapter to the adjudicatory hearing as well as all other major decision-making stages. A unique feature is its in-depth coverage of plea bargaining. Also featured are topics such as parental role in the juvenile justice system, school searches, and the origin of juvenile court. several chapters, detailing how many youths have been affected by various decisions made in the juvenile justice system (such as arrest, detention, transfer to adult court, adjudication, being placed on probation, or committed to residential placement). In addition, the appendices identify juvenile justice standards for all 50 states and Washington, DC, as well as the federal jurisdiction. These standards apply to all decisions made within the juvenile justice system, including arrest, detention, diversion, intake, transfer, adjudication, disposition, and postdispositional stages. The text is written in a conversational, reader-friendly style. Each chapter describes and analyzes, step by step, what young alleged offenders experience in each successive stage of the court process. For each chapter, outlines of key terms and concepts aid student comprehension and serve as a starting point for class discussion. Each chapter also features discussion questions designed to stimulate students' critical thinking. A comprehensive Instructor's Manual/Testing Program is available. of the book.
