Book Synopsis Measuring Police Integrity Across the World by : Sanja Kutnjak Ivković
Download or read book Measuring Police Integrity Across the World written by Sanja Kutnjak Ivković and published by Springer. This book was released on 2015-06-10 with total page 383 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings together research on police integrity on regions worldwide. The results for each country indicate whether police officers know the official rules, how seriously they view police misconduct, what they think the appropriate and expected discipline for misconduct should be, and how willing they are to report it. Police misconduct refers to everything from corruption and use excessive force, to perjury, falsification of evidence, and failure to react. Police Integrity and police misconduct are topics of great concern worldwide. Police integrity is envisioned as the inclination to resist temptations to abuse the rights and privileges of police occupation. Using their extensive experience studying police integrity in the United States, the editors have created an applicable framework for measuring police integrity in other countries. The results of their research are brought together in this timely volume, including contributions from both established democracies and countries in transition, which each present unique challenges for improving police integrity. Each chapter follows the same format and contains a theoretical analysis of the relevant legal, historical, political, social, and economic conditions in the country, followed by the analyses of empirical results and policy recommendations. In the last chapter, editors Kutnjak Ivković and Haberfeld take a comparative look across the countries by engaging in the in-depth comparative analysis. This work will be of interest to researchers and policy-makers studying policing both in the United States and internationally, presenting a theoretical framework that can be applied to other regions for further research.

Available in PDF, EPUB and Kindle. Book excerpt: The book provides a systematic examination of the legal, fiscal and institutional frameworks for the commercial development of petroleum and solid mineral resources in Africa. First, it considers the values, assumptions, and guiding principles underpinning legislation and governance in Africa’s extractive sector. It then provides detailed and comparative evaluations of regulatory frameworks, pricing, local content, procurement, sales, and contractual arrangements across African extractive industries. Further, the book assesses how questions of business and human rights risks, accountability, corporate social responsibility, waste and pollution control, environmental justice, and participatory development have been addressed to date, and how they could be addressed better in the future. Enhancing readers’ understanding of the geography, sources and scope of extractive resources in Africa, the book explains how corporations can effectively identify, mitigate and prevent legal and business risks when investing in African extractive industries. Lastly, it discusses the innovative legal strategies and tools needed to achieve a sustainable and rights-based extractive industry.Written in a user-friendly style, the book offers a valuable resource for corporations, investors, environmental and human rights administrators, advocates, policymakers, judges, international negotiators, government officials and consultants who advise on, or are interested in, petroleum and solid mineral investments in Africa. It also offers students and researchers an authoritative guidebook to the current state of extractive industry laws and institutions in Africa. Numerous examples of how international legal norms could be used to help revitalize the underlying legal and fiscal regimes in African extractive industries – to make them more robust, accountable, sustainable and rights-based – round out the coverage
Book Synopsis Property and Human Rights in a Global Context by : Ting Xu
Download or read book Property and Human Rights in a Global Context written by Ting Xu and published by Bloomsbury Publishing. This book was released on 2016-03-24 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: Property as a human rights concern is manifested through its incorporation in international instruments and as a subject of the law through property-related cases considered by international human rights organs. Yet, for the most part, the relationship between property and human rights has been discussed in rather superficial terms, lacking a clear substantive connection or common language. That said, the currents of globalisation have witnessed a new era of interrelation between these two areas of the law, including the emergence of international intellectual property law and the recognition of indigenous claims, which, in fundamental ways, speak to an engagement with human rights law. This collection starts the conversation between human rights lawyers and property lawyers and explores analytical approaches to the increasing relationship between property and human rights in a global context. The chapters engage with key theoretical and policy debates and range across three main themes: The re-evaluation of the public/private divide in the law; the tensions between the market and social justice in development and the balance between the rights of individuals and those of communities. The chapters adopt a global, comparative perspective and engage in case studies from countries including India, Philippines, Brazil, the United States, the United Kingdom and includes various regions of Africa and Europe.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the links between employee-organisation relationships, work wellness and the impact thereof on the labour market from a South African perspective. By employing this focus, the book explains the role of the employment relationship and the psychological contract in improving work wellness. To do so, it reviews the establishment and management of contracts in the context of labour relations at South African organisations. The studies presented focus on a range of topics, from individual wellness, the employment relationship and psychological contract, to relational wellness, the broader labour approach, and industrial action. The book presents a structural framework from an individual and labour relational perspective that links the employee-organisation relationship with wellness and its economic value, making it of interest to general and financial managers seeking to better grasp the link between work wellness and its financial implications.
Book Synopsis Fighting Corruption in Public Procurement by : Sope Williams-Elegbe
Download or read book Fighting Corruption in Public Procurement written by Sope Williams-Elegbe and published by Bloomsbury Publishing. This book was released on 2012-11-06 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: Anti-corruption measures have firmly taken centre stage in the development agenda of international organisations as well as in developed and developing countries. One area in which corruption manifests itself is in public procurement and, as a result, States have adopted various measures to prevent and curb corruption in public procurement. One such mechanism for dealing with procurement corruption is to debar or disqualify corrupt suppliers from bidding for or otherwise obtaining government contracts. This book examines the issues and challenges raised by the debarment or disqualification of corrupt suppliers from public contracts. Implementing a disqualification mechanism in public procurement raises serious practical and conceptual difficulties, which are not always considered by legislative provisions on disqualification. Some of the problems that may arise from the use of disqualifications include determining whether a conviction for corruption ought to be a pre-requisite to disqualification, bearing in mind that corruption thrives in secret, resulting in a dearth of convictions. Another issue is determining how to balance the tension between granting adequate procedural safeguards to a supplier in disqualification proceedings and not delaying the procurement process. A further issue is determining the scope of the disqualification in the sense of determining whether it applies to firms, natural persons, subcontractors, subsidiaries or other persons related to the corrupt firm and whether disqualification will lead to the termination of existing contracts. The book compares and contrasts the legal, practical and institutional approaches to the implementation of the disqualification mechanism in the European Union, the United Kingdom, the United States, the Republic of South Africa and the World Bank.

Book Synopsis Strong NGOs and Weak States by : Milli May Lake
Download or read book Strong NGOs and Weak States written by Milli May Lake and published by Cambridge University Press. This book was released on 2018-05-31 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past decade, DR Congo and South Africa have attracted global attention for high rates of sexual and gender-based violence. Why is it that courts in eastern DR Congo have offered a robust judicial response, prioritizing gender crimes despite considerable logistical challenges, whilst courts in South Africa, home to a far stronger legal infrastructure and human rights record, have failed to provide justice to victims of similar crimes? Lake shows that state fragility in DR Congo has created openings for human rights NGOs to influence legal processes in ways that have proved impossible in countries like South Africa, where the state is stronger. Yet exploiting opportunities presented by state fragility to pursue narrow human rights goals invites a host of new challenges. Strong NGOs and Weak States documents the promises and pitfalls of human rights and rule of law advocacy undertaken by NGOs in strong and weak states alike.
