Book excerpt: In this volume, Latin Americanist scholars explore the recent evidence relating to the ways in which partial state failure in the continent is interacting with new types of organized violence, thereby undermining the process of democratic consolidation that has characterized Latin America over the past two decades. This 'new violence' stems - as this book's case studies from Colombia, Peru, Argentina, Venezuela, Brazil and other countries, including El Salvador, show - from a heterogeneous variety of social actors including drug mafias, peasant militias and urban gangs (collectively referred to as actores armadas), as well as state-related actors like the police, military intelligence agencies and paramilitary forces. These armed actors are reproducing organized social and political violence beyond the confines of democratic politics and civil society. The results, as the authors warn, include both 'governance voids' - domains where the legitimate state is effectively absent in the face of armed actors prevailing by force - and an erosion of the capacity and willingness of state officials themselves to abide by the rule of law. These tendencies, in turn, pave the way for a possible reinstallation of authoritarian regimes under the control of politicized armies or, at the very least, the spread of state violence in one form or another. Why these tendencies need to be taken so seriously is, the authors argue, because of the deeper social roots underlying them - notably the failure of neoliberal economic policies and weakened state structures to deliver the jobs, standards of living and social services every democratic citizenry has a right to expect. The Argentinian collapse and persistent Colombian and Venezuelan crises receive special attention in this regard.

Book excerpt: The book delves into constitutional essays focused on Latin America, with a particular emphasis on Peru. It explores legal theories surrounding the development of human rights, rooted in constitutional pluralism. Drawing from the insights gathered by organizations within the Inter-American Human Rights System, notably the Court and the Commission, this examination extends to its impact on local judicial bodies, including the Judiciary and notably the Constitutional Court. These efforts aim to protect traditional civil and political rights alongside social rights. However, the work also addresses the ongoing challenge of safeguarding emerging rights, such as fundamental digital and environmental rights, while bolstering protections for vulnerable populations like migrants and the LGBTQ+ community. By adopting a holistic approach, the book aspires to serve as a valuable resource for academics, experts, students, and professionals engaged in the study and practice of Latin American Constitutionalism.

A new business model, product or technological service emerges all the time. Along with the facilitation and solutions brought by technological development, new problems, conflicts and litigation in social and economic relations also arise. Laws of several countries are not often able to keep up with the digital dynamism. Furthermore, there is not a consensus in international trade organisations on the concept of digital services and electronic commerce. That is the scenario in which the European Union has constantly developed rules to regulate the digital environment, ensuring and combining legal security and standardisation of rules with the practical advantages of these new social and trade relations, stimulating innovation and economic growth. While the WTO and the OECD have not reached a consensus on this matter, the EU has been influencing rules around the world and adding chapters on electronic commerce to its deep integration trade agreements with third countries. The book analyses EU regulations regarding the online environment such as personal data protection, electronic commerce, electronic contract, electronic signature and identification, advertising, digital services, consumer rights, and taxation. It addresses several decisions made by the Court of Justice and national courts of the EU. The influence of the EU in Mercosur is demonstrated through the analysis of laws and jurisprudence of Mercosur countries.

Book excerpt: This book examines the reasoning practice of 15 constitutional courts and supreme courts, including the Caribbean Commonwealth and the Inter-American Court of Human Rights. Enriched by empirical data, with which it strives to contribute to a constructive and well-informed debate, the volume analyses how Latin American courts justify their decisions. Based on original data and a region-specific methodology, the book provides a systematic analysis utilising more than 600 leading cases. It shows which interpretive methods and concepts are most favoured by Latin American courts, and which courts were the most prolific in their reasoning activities. The volume traces the features of judicial dialogue on a regional and sub-regional level and enables the evaluation and comparison of each country's reasoning culture in different epochs. The collection includes several graphs to visualise the changes and tendencies of the reasoning practices throughout time in the region, based on information gathered from the dataset. To better understand the current functioning and the future tendencies of courts in Latin America and the Caribbean, the volume illuminates how constitutional and supreme courts have actually been making their decisions in the selected landmark cases, which could also contribute to future successful litigation strategies for both national constitutional courts and the Inter-American Court for Human Rights. This project was made possible due to the collaboration and funding provided by the Rule of Law Programme for Latin America of the Konrad Adenauer Foundation and the Law School of the University of San Francisco de Quito.

Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.

Book excerpt: Papers from the Second World Phenomenology Congress (convened September 12-18, 1995 in Guadalajara, Mexico) articulate the four main tenets of the ontopoiesis of life: the priority of the creative act over the cognitive intentional act; the revelation that the human creative condition is pivotal in tracing specifically human powers; that the creative act of the human being is the meeting ground for all human endeavors; and the ontopoietic self-individualization of life. Book excerpt: Making Globalization Work for Women explores the potential for trade unions to defend the socioeconomic rights of women in a global context. Looking at labor policies and interviews with people in unions and nongovernmental organizations, the essays diagnose the problems faced by women workers across the world and assess the progress that unions in various countries have made in responding to those problems. Some concerns addressed include the masculine culture of many unions and the challenges of female leadership within them, laissez-faire governance, and the limited success of organizations working on these issues globally. Making Globalization Work for Women brings together in a synthetic and fruitful conversation the work and ideas of feminists, unions, NGOs, and other human rights workers.
