Book excerpt: The entity called Nigeria, has for over 50 years of its existence been a developing country or put another way a third world country. In a bid to break this barrier its laws have to be formulated in way that will post-date growth in the society. The new legislation, the Petroleum Industry Bill (PIB), is currently under legislative consideration and represents the most comprehensive review of the legal framework for the oil and gas sector in Nigeria since the industry began commercial operations in the 1960s. It could signal the dawn of a new era; an era during which restructuring and transformation could address many of the issues that have dominated the oil and gas industry in sub-Saharan Africa's second-biggest economy. It is of a ruinous effect if this sector is neglected to the hands of human greed and avarice. As a result this bill has constantly met a brick wall at the National Assembly. It then comes to question the reasons for this delay. If the proposed bill will do more harm than good to the country, why then has it been ingloriously delayed? The law is amongst other things for the stability and growth of the society, so no stakeholder, investor or even the government is permitted to hinder the law from performing its functions. This will be tantamount to repugnance to natural justice, equity and good conscience.

Now, he's a man on a mission, the founder of Citizens for Affordable Energy, crisscrossing the country in a grassroots campaign to change the way we look at energy in this country. While pundits proffer false new promises of green energy independence, or flatly deny the existence of a problem, Hofmeister offers an insider's view of what's behind the energy companies' posturing, and how politicians use energy misinformation, disinformation, and lack of information to get and stay elected. He tackles the energy controversy head-on, without regard for political correctness. He also provides a new framework for solving difficult problems, identifying solutions that will lead to a future of comfortable lifestyles, affordable and clean energy, environmental protection, and sustained economic competitiveness.

Available in PDF, EPUB and Kindle. Book excerpt: The recent calls for the revival of the Oil Price Stabilization Fund (OPSF) are tantamount to a call for a policy reversal, that is, reversal of the downstream oil industry deregulation that began in 1998. The history of the OPSF presents important lessons for policymakers. Petroleum price setting by fiat and using a price stabilization fund to smooth the price resulted in mismatches between payments to the fund and claims against it. The general public then ended up subsidizing oil consumers through subsidies from the national budget. When faced with political pressures, policymakers also lacked discipline in sticking to the price stabilization purpose of the OPSF, such as failing to implement the increase in the regulated price when the magnitude was large and allowing the use of the fund for something not directly related to price stabilization. Settling the legal challenges to OPSF credits and payments with finality also took time. Price distortion also resulted in cross-subsidization that created mismatches between demand and environmental objectives. Although there remain a few countries that have price stabilization funds, all of them are finding it hard to sustain funds operation and dealing with large deficits. Besides, the general direction of reforms globally is to remove fossil fuel subsidies. [...].
