The general understanding of policymaking has Congress making the laws, executive agencies implementing them, and the courts applying the laws as written—as long as those laws are constitutional. Making Policy, Making Law fundamentally challenges this conventional wisdom, arguing that no dominant institution—or even a roughly consistent pattern of relationships—exists among the various players in the federal policymaking process. Instead, at different times and under various conditions, all branches play roles not only in making public policy, but in enforcing and legitimizing it as well. This is the first text that looks in depth at this complex interplay of all three branches. The common thread among these diverse patterns is an ongoing dialogue among roughly coequal actors in various branches and levels of government. Those interactions are driven by processes of conflict and persuasion distinctive to specific policy arenas as well as by the ideas, institutional realities, and interests of specific policy communities. Although complex, this fresh examination does not render the policymaking process incomprehensible; rather, it encourages scholars to look beyond the narrow study of individual institutions and reach across disciplinary boundaries to discover recurring patterns of interbranch dialogue that define (and refine) contemporary American policy. Making Policy, Making Law provides a combination of contemporary policy analysis, an interbranch perspective, and diverse methodological approaches that speak to a surprisingly overlooked gap in the literature dealing with the role of the courts in the American policymaking process. Elected leaders confront equally difficult dilemmas when courts issue decisions challenging their actions. Based on extensive fieldwork in Argentina and Brazil, this study identifies striking variation in inter-branch interactions between the two countries. In Argentina, while the high court often defers to politicians in the economic realm, inter-branch relations are punctuated by tense bouts of conflict. The Brazilian high court and elected officials, by contrast, routinely accommodate one another in their decisions about economic policy. Book excerpt: As many formerly authoritarian regimes have been replaced by democratic governments in Latin America, Eastern Europe, and elsewhere, questions have arisen about the stability and durability of these new governments. One concern has to do with the institutional arrangements for governing bequeathed to the new democratic regimes by their authoritarian predecessors and with the related issue of whether presidential or parliamentary systems work better for the consolidation of democracy. In this book, Peter Siavelis takes a close look at the important case of Chile, which had a long tradition of successful legislative resolution of conflict but was left by the Pinochet regime with a changed institutional framework that greatly strengthened the presidency at the expense of the legislature. Weakening of the legislature combined with an exclusionary electoral system, Siavelis argues, undermines the ability of Chile's National Congress to play its former role as an arena of accommodation, creating serious obstacles to interbranch cooperation and, ultimately, democratic governability. Unlike other studies that contrast presidential and parliamentary systems in the large, Siavelis examines a variety of factors, including socioeconomic conditions and characteristics of political parties, that affect whether or not one of these systems will operate more or less successfully at any given time. He also offers proposals for institutional reform that could mitigate the harm he expects the current political structure to produce.
