Book excerpt: Research Paper (undergraduate) from the year 2021 in the subject Sociology - Law and Delinquency, grade: 1, National Islamic University, language: English, abstract: Adoption occurred primarily to preserve and transmit family lines or inheritance, to gain political power or to forge alliance between families. The issue highlighted in this paper is the protection of children from illegal adoption or adoptions that are done for an illegal purpose like human trafficking. Human trafficking is a major concern not only intra-country but also inter-country. The aim of this paper is to identify the problem and suggest ways to a better solution. The first topic is a brief history in which the genesis of adoption is explained, and it is discussed whether adoption is really for the welfare of the child. Furthermore, the relationship between inter-country adoption and India is explained. It is analysed, what laws provide such kind of adoptions, what is lacking in those laws, what their impact is and if the adoption is really happening in the country. Additionally, the international laws of adoption and whether they help in protecting the interest of the child are discussed. Then, the problem of child trafficking based on illegal adoption, how far the laws dealt with it, what has to be done and how to protect children from such abuses is explained. There must be a strong, stable and legitimate inter-country adoption infrastructure. Adoption can only maintain a principled and enforceable line against child selling and child trafficking when effective systems of enforceable regulation are in place that effectively prevent adoption systems from becoming markets for children. The refusal or failure of the domestic and inter-country adoption systems to put those needed regulations into place speaks volumes regarding the ethics of the domestic and inter-country adoption. Inter-country adoption is a conditional good; inter-country adoption as child trafficking is an evil.

Available in PDF, EPUB and Kindle. Book excerpt: Adoption has always had a political dimension. Its potential use to achieve political ends has been evident throughout history and in many different cultures. In Roman 1 times an emperor would adopt a successful general to continue his rule. In Ireland under the Brehon Laws the reciprocal placements of children between clans was 2 an accepted means of cementing mutual allegiances. In Japan the adoption of non-relatives was traditionally seen as a means of allying with the fortunes of 3 the ruling family. The willingness of governments to use adoption as a political strategy was apparent, for example, in Australia where it was used to further 4 the assimilation of indigenous people. It is now present in the phenomenon of intercountry adoption where the ?ow of children, particularly in the aftermath of war, is often politics by proxy and which arguably attracts the involvement of 5 some countries for reasons of economic and political expediency. Adoption does not function in isolation. It plays a distinct role within the c- text of family law proceedings. The extent to which it is available as a resource for children in the public care system or as an adjunct to marriage proceedings is essentially politically determined. It is itself susceptible to political in?uence. 6 In fact direct political leadership, exercised ?rst by President Clinton and then 1 See, Gibbons, The Decline and Fall of the Roman Empire, Harrap, London 1949 at p. 30.

Book excerpt: Global Trade Law Series, Volume 55 India, one of the world’s foremost trading nations, exhibits a particularly complex regulatory landscape with a variety of standard-setting bodies, regulators, accreditation and certification bodies, inspection agencies, as well as several state-level regulators. This is the first book to extensively describe the nature of standard-setting processes in India and the key agencies involved with this task, greatly clarifying the scope of market opportunities in the country. Lucid contributions from experienced practitioners and regulators with first-hand experience in formulating and advising on standards-related issues in international trade help disentangle the web of laws, regulations, operations, and functions of India’s standard setters in governmental, non-governmental, and industry contexts. The chapters describe how standards apply to such crucial trade aspects as the following: conformity assessment practice and procedure; environmental, ethical, social, and safety issues; import bans and import licensing; certification and labelling measures; mutual recognition agreements; food safety; and standardisation of the digital economy. The book is drafted throughout in an easy-to-read style, with numerous tables, flowcharts, and figures illustrating step-by-step compliance procedures. Informative annexes guide the reader to relevant agencies and identify their roles and responsibilities. This book provides a clear and concise guide to the operations, functions, and compliance and documentation requirements of India’s standard-setting and regulatory bodies across all sectors and products, and thus will serve as an unmatched guide for manufacturers, traders, and exporters operating in the Indian market or seeking to export to India. It will also serve as a useful Handbook to policymakers, academics, and researchers interested in understanding the role of standard-setting bodies in the field of international trade.

Analysing both public and private international legal aspects, this cross-disciplinary text promotes a holistic understanding of the ongoing development of child law, children’s rights and the protection of the child. In-depth analyses of the following topic areas are included: Childhood in the digital age; Child labour; International parental child abduction; Inter-country adoption; Sexual exploitation; Children and armed conflict; and Indigenous children. These topics are contextualised with further chapters on the concept of childhood and children’s rights, the international legal framework in which the Convention operates and a substantive chapter on the Convention itself. This fourth edition has been updated and revised, including a new chapter dealing with issues arising from childhood in the age of unprecedented digital technological advancements; a crucial issue for childhood experiences in modern times. This edition also includes new case studies, recent legal developments in the field of international child law, and inclusion of broader scholarship to capture diverse views on international law and child law. The aim of this book is to provide the reader with an accessible, informed, critical and scholarly account of the international law framework relating to children. Drawing on a range of legal and other disciplines, this book remains a valuable resource for those in the course of study and research in this area.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides an authoritative account of the evolution and application of private international law principles in India in civil commercial and family matters. Through a structured evaluation of the legislative and judicial decisions, the authors examine the private international law in the Republic and whether it conforms to international standards and best practices as adopted in major jurisdictions such as the European Union, the United Kingdom, the United States, India's BRICS partners - Brazil, Russia, China and South Africa and other common law systems such as Australia, Canada, New Zealand, and Nepal. Divided into 13 chapters, the book provides a contextualised understanding of legal transformation on key aspects of the Indian conflict-of-law rules on jurisdiction, applicable law and the recognition and enforcement of foreign judgments or arbitral awards. Particularly fascinating in this regard is the discussion and focus on both traditional and contemporary areas of private international law, including marriage, divorce, contractual concerns, the fourth industrial revolution, product liability, e-commerce, intellectual property, child custody, surrogacy and the complicated interface of 'Sharia' in the conflict-of-law framework. The book deliberates the nuanced perspective of endorsing the Hague Conference on Private International Law instruments favouring enhanced uniformity and predictability in matters of choice of court, applicable law and the recognition and enforcement of foreign judgments. The book's international and comparative focus makes it eminently resourceful for legislators, the judges of Indian courts and other interested parties such as lawyers and litigants when they are confronted with cross-border disputes that involve an examination of India's private international law. The book also provides a comprehensive understanding of Indian private international law, which will be useful for academics and researchers looking for an in-depth discussion on the subject.
