Book excerpt: Underground Economies and Illegal Imports: Business and Legal Strategies to Address Illegal Commerce is a unique resource for lawyers and their clients facing the chaotic landscape of illegal trade in the black and gray markets, where legal remedies are often unobtainable or impracticable. Donald E. deKieffer-a practitioner who has represented more than 60 Fortune 500 companies both in the US and abroad-provides clear descriptions of how international supply and distribution chains are attacked by clever and not-so-subtle thieves around the world. This book is also a helpful source of examples and instructions on how to prepare for these attacks, and the best remedies when they do occur. Underground Economies and Illegal Imports: Business and Legal Strategies to Address Illegal Commerce is a one-of-a-kind guide to the underside of international trade for businesses, law enforcement and policy-makers. The illicit dealers in legitimate (or not-so-legitimate) merchandise are often linked with transnational criminal elements and even terrorists. This book assists international traders in avoiding these problems, or ameliorating any effects.

Available in PDF, EPUB and Kindle. Book excerpt: In 2016, social media users in Thailand called out the Paris-based luxury fashion house Balenciaga for copying the popular Thai “rainbow bag,” using Balenciaga’s hashtags to circulate memes revealing the source of the bags’ design. In Why We Can’t Have Nice Things Minh-Ha T. Pham examines the way social media users monitor the fashion market for the appearance of knockoff fashion, design theft, and plagiarism. Tracing the history of fashion antipiracy efforts back to the 1930s, she foregrounds the work of policing that has been tacitly outsourced to social media. Despite the social media concern for ethical fashion and consumption and the good intentions behind design policing, Pham shows that it has ironically deepened forms of social and market inequality, as it relies on and reinforces racist and colonial norms and ideas about what constitutes copying and what counts as creativity. These struggles over ethical fashion and intellectual property, Pham demonstrates, constitute deeper struggles over the colonial legacies of cultural property in digital and global economies.

Available in PDF, EPUB and Kindle. Book excerpt: 'Professor Blakeney has written a detailed work on the current state of international enforcement of intellectual property rights. Using the background to, and the negotiation of, the Anti-Counterfeiting Trade Agreement, as well as the provisions of the ACTA itself, the book is a mine of information and analysis. Professor Blakeney's long experience of work on the laws and practice of IPR enforcement as a right-holder, an administrator, and as an academic and researcher, are second to none and it shows in this all-encompassing work.' – John Anderson, Global Anti-Counterfeiting Network This important book is the first detailed analytical treatment of the Anti-Counterfeiting Trade Agreement (ACTA) and its impact on intellectual property enforcement. The ACTA had been formulated to deal with the burgeoning growth in the trade in counterfeit and pirate products which was estimated to have increased ten-fold since the promulgation of the TRIPS Agreement in 1994. The book clarifies how the ACTA supplements the enforcement provisions of the TRIPS Agreement, namely by: expanding the reach of border protection to infringing goods in transit; providing greater detail of the implementation of civil enforcement and; providing for the confiscation of the proceeds of intellectual property crimes. As the book illustrates, a significant additional innovation is the introduction of provisions dealing with enforcement of intellectual property rights in the digital environment. This book will strongly appeal to intellectual property rights policymakers at the World Trade Organization and World Intellectual Property Organization, legal practitioners, academics and students.

Available in PDF, EPUB and Kindle. Book excerpt: Fraud and piracy of products and ideas have become common in the early twenty-first century, as opportunities to commit them expand, and technology makes fraud and piracy easy to carry out. In Combating Piracy: Intellectual Property Theft and Fraud, Jay S. Albanese and his contributors provide new analyses of intellectual property theft and how perpetrators innovate and adapt in response to shifting opportunities. The cases described here illustrate the wide-ranging nature of the activity and the spectrum of persons involved in piracy of intellectual property. Intellectual property theft includes stolen copyrights, trademarks, trade secrets, and patents, which represent the creative work of individuals for which others cannot claim credit. The distributors of books, movies, music, and other forms of intellectual property pay for this right, and those who distribute this work without compensation to its creator effectively hijack or "pirate" that property without the owner's or distributor's permission. The problem has grown to the point where most software in many parts of the world is pirated. The World Health Organization estimates that 10 percent of all pharmaceuticals available worldwide are counterfeit. Such widespread fraud illustrates the global reach of the problem and the need for international remedies that include changed attitudes, public education, increasing the likelihood of apprehension, and reducing available opportunities. The contributors show that piracy is a form of fraud, a form of organized crime, a white-collar crime, a criminal activity with causes we can isolate and prevent, and a global problem. This book examines each of these perspectives to determine how they contribute to our understanding of the issues involved.

Available in PDF, EPUB and Kindle. Book excerpt: ÔIn recent years a great deal has been written about terrorism and how best to inhibit and undermine terroristÕs aspirations. Much of this literature tends to be one dimensional reflecting the experience of the author. Dr Ridley having had a long and diverse career in intelligence and in particular financial analysis has succeeded in going far beyond description of a series of war stories to providing not only a starting account of the range and character of modern terrorism, but also a knowledgeable analysis of the measures adopted around the world to combat the threat. Of critical importance, in the minds of many, has been the adoption of techniques in the main from the Òwar against drugsÓ facilitating the identification and disruption of finance. While emphasising the value of financial intelligence Dr Ridley, now as a scholar, dispassionately questions how successful this strategy has been and where it might take us. Such issues need to be aired and resolved if we are not to undermine the very values which we seek to protect.Õ Ð Barry Rider, University of Cambridge, UK ÔThis is hugely important and highly relevant contribution by a world expert, which adds to our knowledge of terrorist funding. It will make practitioners and academics alike, not to mention politicians who should be seeking their advice, stop and think.Õ Ð John Grieve, Portsmouth University, UK and former UK National Co-ordinator for Counter Terrorism ÔDr. Ridley has authored an excellent, analytical, comprehensive, and solutions-oriented book addressing the complexities of terror financing and the challenges in combating this menace. Dr. RidleyÕs unique insight, arising from substantial academic and professional experiences on combating terror financing, lends substantial credibility to the volume.Õ Ð Dean C. Alexander, Western Illinois University, US This authoritative book provides a holistic overview of terrorist groups and finances, including consideration of the necessity and differing financial needs of different groups. For over a decade international efforts by law enforcement, government and financial regulatory authorities have been deployed in combatting terrorist financing, in good faith and with dedication beyond reproach. This book surveys the methods of financing of numerous terrorist groups and organisations Ð including the Chinese and Asian dimension Ð and considers why ultimately international efforts to combat the financing of terror are failing. Nick Ridley expertly illustrates the scale of the problem by first outlining the strategies of anti terrorist financing, the pre and post 9/11 differences in scope and extent of terrorist attacks, the financial support and the national and international efforts to implement and carry out countermeasures. He then goes on to set out a detailed analysis of the apparent failure of such counter measures to date. Including operational case studies and details from the authors own experience, studies and access to law enforcement and private sector sources, this book will prove insightful for undergraduate and postgraduate students studying criminology, history and law disciplines. Those in the legal profession will also find plenty of useful information in this topical compendium.

Available in PDF, EPUB and Kindle. Book excerpt: The United States and her allies have found themselves plunged into ‘a war over [humanity’s] future social and political organization’ with criminal challengers to the nation-state form. These new wars are currently being fought globally with Al Qaeda, in Iraq with shifting coalitions of criminal gangs, insurgents, and Jihadi groups and throughout the Americas with the Maras (the first group of 3rd GEN Gangs to emerge). More new wars are poised to develop and the on-going ones are far from over, with more attacks upon the homelands of the US and her allies expected. This cutting edge book looks initially at the theoretical and legal side of criminal-state and criminal-soldier emergence and growth, before focusing on criminal-states and criminal-soldiers themselves, with particular attention paid to Al Qaeda, Hizballah, Mara Salvatrucha (MS 13), Caliphate and Mahdi concerns, Islamic Fundamentalist Use of Beheadings, Criminalization of Russian State Security, Nuclear Materials Trafficking, and Outlaw Private Security Firms. With the contributions from international experts, this book makes for critical reading for political scientists and criminal justice students and researchers, policy makers, and military and law enforcement practitioners. This book was previously published as a special issue of Global Crime.
