Book excerpt: "El análisis del marco jurídico del agua y su institucionalidad es una actividad que implica un detallado estudio de fuentes dispersas en la legislación nacional, que se remontan en algunos casos a la época de la República -refl ejo de la infl uencia del modelo francés-; hasta las más modernas regulaciones alineadas con las aspiraciones de derechos humanos y garantistas de los últimos quince años. El análisis de la jurisprudencia, nos lleva de la mano por los razonamientos más acordes con un enfoque biocéntrico del agua, que pone en perspectiva al ser humano en su relación con el entorno y la sostenibilidad de los procesos naturales y algo tan etéreo como el ciclo hidrológico y, que evidentemente procura cerrar las brechas de una norma del siglo pasado inserta en la modernidad del derecho internacional público, derecho humanitario y de la Constitución; aunque también nos topamos con barreras infranqueables que tutelan el derecho privado asociado al fundo, obviando la naturaleza pública del recurso hídrico. El objetivo de este estudio, fue analizar las tendencias que muestra la legislación adoptada por trece países de Latinoamérica sobre el tema hídrico. Se clasifi caron y organizaron las diversas regulaciones de conformidad con lo dispuesto por la Doctrina de Gobernabilidad del Agua, lo que permitió sistematizar la información obtenida y presentarla de una manera simple. Para cumplir con el objetivo se realizó un análisis documental de las constituciones, leyes y políticas públicas vigentes sobre la gestión del agua y, mucha de esta normativa responde a una organización sectorial del recurso; además se han revisado las normas sobre agua potable, para riego, acuicultura, navegación y aguas compartidas. Las fuentes de consulta más frecuentes fueron las páginas web ofi ciales de las distintas autoridades nacionales, reservorios ofi ciales como FAOLEX, Organización de Estados Americanos (OEA), bibliotecas nacionales y reservorios judiciales. A partir del estudio realizado, se puede concluir que relativamente pocos países de la región han adoptado una ley de agua en el último siglo y que pocas de estas regulaciones se ocupan de desarrollar adecuadamente la institucionalidad para la gestión del agua o el Principio 10 de la Declaración de Río sobre Medio Ambiente y Desarrollo (1992) que procura garantizar el acceso a la información, la participación en la toma de decisiones y la posibilidad procesal de accionar ante los tribunales de justicia en casos que involucren el medio ambiente. Más aún, todo ello debe refl ejarse en la institucionalidad del agua. También se reconocen importantes debilidades que difi cultan la implementación de las leyes vigentes, ya sea por falta de fuentes permanentes de fi nanciamiento; por el enfoque sectorial del uso del recurso; por la debilidad del ente rector o por su incapacidad para generar mecanismos funcionales de coordinación multisectorial."--Page 7.
