Available in PDF, EPUB and Kindle. Book excerpt: Who should police corporate misconduct and how should it be policed? In recent years, the Department of Justice has resolved investigations of dozens of Fortune 500 companies via deferred prosecution agreements and non-prosecution agreements, where, instead of facing criminal charges, these companies become regulated by outside agencies. Increasingly, the threat of prosecution and such prosecution agreements is being used to regulate corporate behavior. This practice has been sharply criticized on numerous fronts: agreements are too lenient, there is too little oversight of these agreements, and, perhaps most important, the criminal prosecutors doing the regulating aren’t subject to the same checks and balances that civil regulatory agencies are. Prosecutors in the Boardroom explores the questions raised by this practice by compiling the insights of the leading lights in the field, including criminal law professors who specialize in the field of corporate criminal liability and criminal law, a top economist at the SEC who studies corporate wrongdoing, and a leading expert on the use of monitors in criminal law. The essays in this volume move beyond criticisms of the practice to closely examine exactly how regulation by prosecutors works. Broadly, the contributors consider who should police corporate misconduct and how it should be policed, and in conclusion offer a policy blueprint of best practices for federal and state prosecution. Book excerpt: Unlike other books of its kind, Understanding White-Collar Crime: An Opportunity Perspectiveuses a coherent theoretical perspective in its coverage of white-collar crime. Using opportunity perspective, or the assumption that all crimes depend on offenders having some sort of opportunity to commit an offense, allows the authors to uncover the processes leading up to white-collar crimes and offer potential solutions to this rampant issue, without being reductive in their treatment of the topic. With this second edition, Benson and Simpson have greatly expanded their coverage to include new case studies, substantive materials, and an annotated appendix of online resources to make this a core book for courses on white-collar crime.

Book excerpt: Members of organized crime syndicates have gained control of key businesses and trade unions through their strategic positions as arbiters of labor-management conflicts and as dispensers of illegal credit. They are managing important sectors of the contemporary marketplace, engaging in activities far more significant than the vice enterprises usually associated with criminal activity. Difficult to access for scholarly study, organized crime is best documented in judicial findings and in legislative reports from criminal investigations and public hearings. In this book, Alan Block has assembled a rich cross section of these reports. Taken together, they illustrate how organized crime has infiltrated important industries and taken control of union pension and welfare funds. Designed for students of criminology, sociology, and deviance, the book provides a comprehensive overview of the business of crime in America today.

Available in PDF, EPUB and Kindle. Book excerpt: Business crime with a corresponding recourse to criminal law and procedure to redress socially unacceptable business conduct continues to rise in many Western countries. In Italy this trend has taken the form of a vast and chaotic collection of special laws, many of them proposed and passed ad hoc in response to specific crimes, and without reference to the Italian Criminal Code or any other systematic body of law. As a result, business activity in Italy is particularly fraught with risk and uncertainty. Italian Law on Business Crime is the first book to sort out and organize this mass of legislative material into a coherent and useful body of law. It offers the business person clear assurance that his or her conduct in the course of entrepreneurial or other business activity in Italy will not fall foul of the law. It also provides guidance in identifying and combating the illegal conduct of others that can arise in such areas as taxation and bankruptcy proceedings. Beginning with a detailed background in the elements of Italian criminal law and business crime in general, Professor Di Amato goes on to analyze the particular crimes that can arise in corporate activity, bankruptcy proceedings, matters of taxation and customs duties, transfer of goods, compliance with environmental standards, competition and other market issues, finance, banking, insurance, securities, financial services, and use of negotiable instruments. The book concludes with a concise and valuable description of Italian criminal procedure.

Criminal liability and intent Stock market and financial crime Bribery and extortion Computer and identity fraud Health care fraud Crime in the professions Industrial pollution Political corruption War crimes and genocide Contributors offer case studies, historical and sociopolitical analyses, theoretical and legal perspectives, and comparative studies, featuring examples as varied as NASA, Parmalat, the Italian government, and Watergate. Richly diverse in its coverage, The International Handbook of White-Collar and Corporate Crime is stimulating reading for students, academics, and professionals in a wide range of fields, from criminology and criminal justice to business and economics, psychology to social policy to ethics.
