Available in PDF, EPUB and Kindle. Book excerpt: The present volume presents a part of the results of a research project launched by the European Science Foundation (ESF) in 1977. Tribute should be paid to the late Professor Aleck Chloros, Judge in the Court of the European Community, whose belief in the European ideal and enthusiasm for European cooperation and the comparative study of legal problems made him an elo quent advocate of a large-scale ESF venture into the field of com parative law. Judge Chloros had envisaged the creation of a per manent, sizable and well-equipped European institute for compa rative legal studies. The successive working parties convoked by the Executive Council of the ESF, which I had the honour of chairing from the beginning, came to the conclusion that this am bitious vision could not be realized immediately; the financial sit uation of the member organizations of the ESF also deteriorated, making a cautious approach a necessary virtue. The solution ulti mately adopted by the last of the working parties - the Ad Hoc Committee for Comparative Law -and submitted to the General Assembly of the ESF in 1979 called for the launching of four pi lot projects. In November 1980, the Assembly approved detailed plans for two of these projects. The first of these - dealing with medical responsibility - has already been presented in an impres sive volume (E. Deutsch and H. -L. Schreiber, editors, Medical Responsibility in Western Europe.

This book was released on 1998-01-01 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, Georgios N. Yannopoulos appropriately relates the developing field of knowledge based systems in law with the basis in classic philosophy, explicating relations which too often are not properly understood. The decision model developed by the author is important, as it integrates and explains arguments which often have been seen as imcompatible. The use of the theoretical foundation in describing and in giving a critical analysis of the construction of real knowledge bases systems becomes therefore very valuable.and’ Jon Bing, Norwegian Research Center for Computers and Law and‘Expert systems in law have not been as easily achieved as was originally envisaged, because too many thought the task to be trivial and ignored the complex issues involved. Yannopoulosand’ work is valuable because he attempts to detail these issues and overcome them.and’ Philip Leith, Queenand’s University of Belfast and‘Yannopoulosand’ book addresses some of the most crucial problems in the field of information technology and law. The development of more advanced IT solutions for the legal sector will always be closely related to our ability to model and understand the legal reasoning process. In his analysis Yannopoulos elegantly integrates knowledge from many different areas, and in this respect the book reflects an all too seldom seen broadness.and’ Pete Wahlgren, The Swedish Law and Informatics Research Institute (IRI) and‘There has been an abundance of recent research on developing intelligent support systems. Dr Yannopoulosand’ work is especially significant because it examines the necessary legal background for building such systems. It will be an essential reference for the prospective builders of intelligent legal support systems.and’ John Zeleznikow, La Trobe University, Bundoora, Australia

Book excerpt: This book provides original, diverse, and timely insights into the nature, scope, and implications of Artificial Intelligence (AI), especially machine learning and natural language processing, in relation to contracting practices and contract law. The chapters feature unique, critical, and in-depth analysis of a range of topical issues, including how the use of AI in contracting affects key principles of contract law (from formation to remedies), the implications for autonomy, consent, and information asymmetries in contracting, and how AI is shaping contracting practices and the laws relating to specific types of contracts and sectors. The contributors represent an interdisciplinary team of lawyers, computer scientists, economists, political scientists, and linguists from academia, legal practice, policy, and the technology sector. The chapters not only engage with salient theories from different disciplines, but also examine current and potential real-world applications and implications of AI in contracting and explore feasible legal, policy, and technological responses to address the challenges presented by AI in this field. The book covers major common and civil law jurisdictions, including the EU, Italy, Germany, UK, US, and China. It should be read by anyone interested in the complex and fast-evolving relationship between AI, contract law, and related areas of law such as business, commercial, consumer, competition, and data protection laws.

The authors include young scholars, lawyers, legal consultants, human rights activists, and practitioners, all of whom Professor Bussani has trained, supervised, and supported throughout their careers. The contributions emphasize the many ways in which Professor Bussani’s teaching and scientific output have enriched, revolutionized, and challenged both theory and practice. They cover e.g. the law of secured transactions, Western law and legal pluralism, fashion law, contract law in China and in the Arab World, contract and tort in the West, scientific evidence, risk regulation, global finance, human rights indicators, anti-discrimination laws, democracy and climate change law.
