Book excerpt: Since the September 11, 2001 terrorist attacks on the World Trade Center, many in the New York City area have become concerned about the possible consequences of a similar attack on the Indian Point nuclear power plantsâ€"located about 40 miles from Manhattan, and have made calls for their closure. Any closure, however, would require actions to replace the 2000 MW of power supplied by the plants. To examine this issue in detail, the Congress directed DOE to request a study from the NRC of options for replacing the power. This report presents detailed review of both demand and supply options for replacing that power as well as meeting expected demand growth in the region. It also assesses institutional considerations for these options along with their expected impacts. Finally, the report provides an analysis of scenarios for implementing the replacement options using simulation modeling.

Available in PDF, EPUB and Kindle. Book excerpt: What is public interest law? How effective is it? What are the limits to litigation as a mechanism for conflict resolution? In this study, economists, lawyers, and sociologists evaluate an institutional form that is new to American society and, indeed, to the world--the public interest law (PIL) organization. The book introduces the reader to the structure, resources, and activities of this "nonprofit industry," and also to the factors that affect PIL firms in their choices of cases and methods of handling them. The authors examine PIL's vast range of contemporary public policy concerns. These incude such general topics as the environment, consumerism, housing, employment discrimination, medical care, occupational health and safety, education finance, and taxation. A number of base studies are presented, and a method for economic analysis and evaluation is introduced and applied. The study points to PIL's success in advocating under-represented interests, in winning courtroom decisions, and in translating legal victories into reallocations of resources. At the same time, it notes the bias of PIL towards test-case litigation, a propensity to focus on judicial victories rather than on real social change, and a tendency to use lawyers even when other types of professionals might be more effective. Many of these problems stem from uncertainty of funding and legal restrictions on "nonprofit" organizations. The result is a set of hurdles that distracts PIL firms from their principal goals. The authors do not limit themselves to PIL, but comment on the effectiveness of legal instruments as devices for social change, and on the behavior of the voluntary nonprofit sector, a little-studied portion of the economy. The book presents a fresh approach to the study of both collective-type economic problems and institutional setting in which public interest law works. Available in PDF, EPUB and Kindle. Book excerpt: Since the dawn of the Atomic Age, nuclear experts have labored to imagine the unimaginable and prevent it. They confronted a deceptively simple question: When is a reactor “safe enough” to adequately protect the public from catastrophe? Some experts sought a deceptively simple answer: an estimate that the odds of a major accident were, literally, a million to one. Far from simple, this search to quantify accident risk proved to be a tremendously complex and controversial endeavor, one that altered the very notion of safety in nuclear power and beyond. Safe Enough? is the first history to trace these contentious efforts, following the Atomic Energy Commission and the Nuclear Regulatory Commission as their experts experimented with tools to quantify accident risk for use in regulation and to persuade the public of nuclear power’s safety. The intense conflict over the value of risk assessment offers a window on the history of the nuclear safety debate and the beliefs of its advocates and opponents. Across seven decades and the accidents at Three Mile Island, Chernobyl, and Fukushima, the quantification of risk has transformed both society’s understanding of the hazards posed by complex technologies and what it takes to make them safe enough.

Available in PDF, EPUB and Kindle. Book excerpt: The late 1960s saw an extraordinary growth in the American nuclear industry: dozens of plants of unprecedented size were ordered throughout the country. Yet at the same time, public concern about the natural environment and suspicion of both government and industry increased dramatically. Containing the Atom is the first scholarly history of nuclear power regulation during those tumultuous years. J. Samuel Walker focuses on the activities of the U.S. Atomic Energy Commission, the agency entrusted with the primary responsibility for the safety of nuclear power, and shows that from the beginning the AEC faced a paradox: it was charged with both promoting and controlling the nuclear power industry. Out of this paradox grew severe tensions, which Walker discusses in detail. His balanced evaluation of the issues and the positions taken by the AEC and others makes this study an invaluable resource for all those interested in the continuing controversies that surround nuclear energy.
