Available in PDF, EPUB and Kindle. Book excerpt: What does it mean for education to be a fundamental right, and how may children benefit from it? Surprisingly, even when the right to education was added to the Indian Constitution as Article 21A, this question barely received any attention. The book identifies justiciability—or, more broadly, enforceability—as the most important feature of Article 21A, meaning that children and their parents must be provided with means to effectively claim their right from the State; otherwise, it would remain a ‘right’ only on paper. The book highlights how lack of access to the Indian judiciary means that the constitutional promise of justiciability remains unfulfilled. It deals with the possible alternative means the State may provide for the poor to claim the benefits under Article 21A, and identifies the grievance-redress mechanism created by the ‘Right of Children to Free and Compulsory Education Act, 2009’ as a potential system of enforcement. Even though this system is found to be deficient, the book concludes with an optimistic outlook, hoping that rights advocates may, in the future, focus on improving such mechanisms for legal empowerment.

Book excerpt: Seminar paper from the year 2016 in the subject Law - Public Law / Constitutional Law / Basic Rights, Damodaram Sanjivayya National Law University, language: English, abstract: Whenever the term “Affirmative action” is used, it is understood that what is being referred to is ‘positive discrimination’ or ‘reservation’, in simplest of the meanings. If one goes by its general meaning, it would mean any act done in furtherance of “fair treatment”. And with the present large awakening era our country is going through, it is time for the meaning of affirmative action to be widened and not be confined only to ‘reservation’. Affirmative action is every step taken, every action done and every statute enacted enabling every underprivileged, prejudiced, deprived person belonging to a minority group or the like, to stand equally. And, especially in case of affirmative action in education, not only shall these actions fall under the definition of ‘affirmative action’ but should also include the duties and roles of the students, parents, teachers and of society as a whole discharged in order to achieve “education for all”, as aimed for by the UNESCO. It is affirmative action when the poor family sends its ward to the nearest school for education instead of forcing him/her to get engaged with the family business. It is affirmative action when a child struggles with his parents for permission to let him go to the school, it is affirmative action when a teacher finds joy in imparting education to the children and the society encourages the school going children and the education.

Book excerpt: This research paper examines the constitutional underpinnings and implementation challenges of the right to education in India, focusing on the implications of the 86th Constitutional Amendment Act of 2002, which introduced Article 21A to the Indian Constitution. The study analyzes the historical context, legislative developments, and systemic issues that have shaped educational rights in India. Despite significant progress in expanding access to education, the paper identifies persistent challenges, including inadequate infrastructure, insufficient teacher training, and regional disparities in educational quality. The research highlights the need for comprehensive policy reforms to address both access and quality aspects of education. Key recommendations include strengthening teacher training programs, enhancing accountability mechanisms, improving inclusive education practices, and addressing socioeconomic barriers to education. The paper concludes that realizing the constitutional promise of the right to education requires sustained efforts from all stakeholders and a holistic approach to educational reform. This study contributes to the ongoing discourse on educational rights and policy in India, offering insights for policymakers, educators, and researchers in the field of education.

In 2021, 171 states were parties to the Covenant. In 2019, an estimated 260 million children worldwide did not have access to school education, and social inequality was a major cause. Book excerpt: As India enters the 21st century, education - as the master determinant of development - has assumed unprecedented importance. The universal right to an elementary education is the focus of the country's Right to Education Act. There is also discussion of the demographic dividend which India can meaningfully earn in the next 25 years, if only the working age population is imparted the requisite skills which pre-supposes a near-universalization of secondary and higher secondary education. At the same time, India is required to vamp up its higher education participation rate. Thus, all stages of education have to be emphasized simultaneously. However, educational pre-requisites need to be accomplished within the political framework of parliamentary federalism, entailing the cooperation of India's two dozen States and half a dozen union territories. Education under India's Constitution is a concurrent subject in which both the State and the Center can legislate. Educational performance in India, which would determine India's economic performance, is therefore crucially modified by Center-State relations. Education vis-a-vis Indian federalism is therefore a vitally important but rather neglected arena. This book fills a crucial gap by covering the gamut of the various sub-areas of education.

Book excerpt: "How did the founders of the most populous democratic nation in the world meet the problem of establishing a democracy after the departure of foreign rule? The justification for British imperial rule had stressed the impossibility of Indian self-government. At the heart of India's founding moment, in which constitution-making and democratization occurred simultaneously, lay the question of how to implement democracy in an environment regarded as unqualified for its existence. India's founders met this challenge in direct terms-the people, they acknowledged, had to be educated to create democratic citizens. But the path to education lay not in being ruled by a superior class of men but rather in the very creation of a self-sustaining politics. Universal suffrage was instituted amidst poverty, illiteracy, social heterogeneity, and centuries of tradition. Under the guidance of B. R. Ambedkar, Indian lawmakers crafted a constitutional system that could respond to the problem of democratization under the most inhospitable of conditions. On January 26, 1950, the Indian constitution-the longest in the world-came into effect. More than half of the world's constitutions have been written in the past three decades. Unlike the constitutional revolutions of the late-eighteenth century, these contemporary revolutions have occurred in countries that are characterized by low levels of economic growth and education; are divided by race, religion, and ethnicity; and have democratized at once, rather than gradually. The Indian founding is a natural reference point for such constitutional moments-when democracy, constitutionalism, and modernity occur simultaneously"--
