Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: In enforcing EU competition law, the Commission employs a unique doctrine of parental antitrust liability: it imposes fines on the parent company of an infringing subsidiary in cases where the parent exercises decisive influence over the subsidiary's commercial policy. Critics of this contentious aspect of EU competition law believe that the doctrine is unfair, ineffective, obscure, disproportionate, contrary to due process, and based upon a dubious, if not extremely flimsy, justificatory foundation. Such criticism raises serious and unanswered questions about the legitimacy of the Commission's efforts to enforce competition law. Parental Liability in EU Competition Law: A Legitimacy-Focused Approach is the first monograph to be dedicated to this controversial topic. Written by Professor Peter Whelan, the book contends that, although the general concept of parental liability can be justified in principle, the current EU-level doctrine of parental antitrust liability in fact suffers from a distinct and problematic lack of legitimacy. More specifically, the said doctrine displays significant deficiencies with respect to effectiveness, fairness, and legality. Given this undesirable state of affairs, Parental Liability in EU Competition Law offers a fully-rationalised, reformulated approach to parental antitrust liability for EU competition law violations that is built around the notion of parental fault. That approach provides a solid normative account of how to impose parental antitrust liability in a manner that is theoretically robust, effective in practice, fair in substance, and legally sound.

Available in PDF, EPUB and Kindle. Book excerpt: This volume contains papers presented at the 18th Annual EU Competition Law and Policy Workshop. The papers examine means of balancing effective (public) competition law enforcement and the requirements of legitimate and accountable exercise of public authority. The authors address the design and performance of various enforcement tools at European and national levels, including sanctions and remedies but also distinctive instruments under Regulation 1/2003 (eg commitment procedures) and under the Treaty on the Functioning of the European Union (Article 106(3) when used as a basis for infringement procedures). From the perspective of legitimacy, reflections focus on the implications of fundamental rights standards and general principles of law for the EU's complex and quasi-federal enforcement architecture. Issues that may sometimes escape judicial scrutiny are also discussed, such as how agencies prioritise their activities, and how investigation responsibilities are distributed within the European Competition Network. Effectiveness and legitimacy are then considered in the context of public enforcement cooperation beyond the EU, where international organisations, regional cooperation and a range of formal and informal modes of governance prevail.

Book excerpt: Artificial intelligence (AI) is the latest technological evolution which is transforming the global economy and is a major part of the “Fourth Industrial Revolution.” This book covers the meaning, types, subfields and applications of AI, including U.S. governmental policies and regulations, ethical and privacy issues, particularly as they pertain and affect facial recognition programs and the Internet-of Things (IoT). There is a lengthy analysis of bias, AI’s effect on the current and future job market, and how AI precipitated fake news. In addition, the text covers basics of intellectual property rights and how AI will transform their protection. The author then moves on to explore international initiatives from the European Union, China’s New Generation Development Plan, other regional areas, and international conventions. The book concludes with a discussion of super intelligence and the question and applicability of consciousness in machines. The interdisciplinary scope of the text will appeal to any scholars, students and general readers interested in the effects of AI on our society, particularly in the fields of STS, economics, law and politics.

Available in PDF, EPUB and Kindle. Book excerpt: Middle-class School Choice in Urban Spaces examines government-funded public schools from a range of perspectives and scholarship in order to examine the historical, political and economic conditions of public schooling within a globalized, post-welfare context. In this book, Rowe argues that post-welfare policy conditions are detrimental to government-funded public schools, as they engender consistent pressure in rearticulating the public school in alignment with the market, produce tensions in serving the more historical conceptualizations of public schooling, and are preoccupied by contemporary profit-driven concerns. Chapters focus on public schooling from different global perspectives, with examples from Chile and the US, to examine how various social movements encapsulate ideologies around public schooling. Rowe also draws upon a rich, five-year ethnographic study of campaigns lobbying the Victorian State Government in Australia for a brand-new, local-specific public school. Critical attention is paid to the public school as a means to achieve empowerment and overcome discrimination, and both a local and global lens are used to identify how parents choose the public school, the values they attach to it, and the strategies they use to obtain it. Also considered, however, are how quality gaps, distances and differences between public schools threaten to undermine the democracy of education as a means for individuals to be socially mobile and escape poverty. This book makes an important contribution to our understanding of global social movements and activism around public education. As such, it will be of key interest to researchers, academics and postgraduate students in the field of education, specifically those working on school choice, class and identity, as well as educational geography.

Book excerpt: Transnational Companies (19th-20th centuries) gathers tests which were presented during the fourth convention of the European Business History Association in Bordeaux in September 2000. Most of them come from matured and well-known business historians or business schools specialists, but a bunch of texts were provided too by junior researchers, who found thus a way to promote their brand new inquiries ! Most branches are studied here, either heavy industries or agrobusiness and textile ; but specific areas are well approached : luxury firms, wine and beverages companies, for instance. The focus of Transnational Companies is to scrutinize the emergence of international policies among enterprises, whether through exports strategies or through direct investments in foreign countries, along branches, ways of development, entrepreneurial undertakings or competition's incentives. The book assesses too the move from internationalisation to transnationalisation in the interwar and mostly since the 1960s : owing to several case studies here presented, business schools and economic historians will be able to foster tuitions and seminars with fresh material. Lest several papers are earmarked to the argument about globalisation, that is the restructuring of firms'organisation towards internationalised internal divisions since the 1970s-1980s, as the book does cover the very last years of the 20th century.
