The slow but steady growth in the protection of imprisoned people’s rights over recent decades in Australia has mostly come from incremental change to prison legislation and common law principles. A radical influence is about to disrupt this slow change. Australian prisons and other closed environments will soon be subject to international inspections by the United Nations Subcommittee on the Prevention of Torture (SPT). This is because the Australian Government ratified the Optional Protocol to the Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) in December 2017. Australia’s international human rights law obligations as they apply to prisons are complex and stem from multiple Treaties. This book distils these obligations into five prerequisites for compliance, consistent with the preventive focus of the OPCAT. They are: reduce reliance on imprisonment align domestic legislation with Australia’s international human rights law obligations shift the focus of imprisonment to the goal of rehabilitation and restoration support prison staff to treat imprisoned people in a human rights–consistent manner ensure decent physical conditions in all prisons. Attention to each of these five areas will help all levels of Australian government and prison managers take the steps required to move towards compliance. Human-rights led prison reform is necessary both to improve the lives of imprisoned people and for Australia to achieve compliance with the international human rights legal obligations to which it has voluntarily committed itself.

Criminological knowledge depolarisation underscores a conscious effort by scholars from the Global South to increase intellectual knowledge focused on developing context-specific responses to issues not aligned to Northern ideological positions and specific to the non-Northern context. Such shifts draw attention to the expanse of spaces beyond Northern centres rife with challenges unlike any specific to those experienced or conceptualised by scholars from the Global North with an applied Northern criminological lens. Applying a postcolonial lens to empirical knowledge from country-specific cases in former colonies in Africa, Asia, the Caribbean, the Pacific, and Latin America, this book examines how policing issues not aligned to Northern ideological positions and specific to non-Northern contexts are addressed. The primary purpose is to share innovations in the field of policing – service provision, threats to security, crime responses, justice and international trends – developed in postcolonial developing-country contexts. Given the aim of the book and the contributors’ own research on issues of policing across the globe, it discusses themes including but not limited to the colonial legacies and their impact on policing; how plural regulatory systems and partnerships are navigated by the police; the linkages between access to justice, community perceptions, and police legitimacy; innovations and challenges in organisational reform, crime prevention, and community partnerships; and the expanding roles of police organisations in the Global South. In turn, the people of a very small and conservative country saw the rapid development of diverse minorities in their midst, especially in the capital, Dublin. From a sociological point of view, such communities posed challenges for the national police force, An Garda Síochána. As part of a strategy to engage with rapidly changing demographics, An Garda Síochána launched the Garda Racial and Intercultural Office (GRIO). In 2001, the author of this book was invited to establish a framework, and practical measures to negotiate the non-discriminatory policing of Ireland’s changing society. The author proposed the appointment of Garda Ethnic Liaison Officers (ELOs) to liaise and reassure members of these new minorities, while developing the officers’ own deeper understanding of difference and vulnerability. These appointed ELOs were trained in cultural awareness and difference by the author, in conjunction with minority representatives, which in turn, influenced their thinking in the delivery of a non-discriminatory front-line police service. The role of the ELO makes the Irish police authorities one of the first in the world with specialist officers dedicated to building relations with minorities. This book has many lessons to offer sociologists, academics, criminologists, lawyers, social policymakers and police institutions dealing with the plight of refugees, asylum seekers, economic migrants and marginalised people the world over.
