Book excerpt: The Study on the state of play of court staff training in EU law and promotion of cooperation between court staff training providers at EU level is a one-year project commissioned by the Directorate General (DG) JUSTICE of the European Commission in order to: Map out the different categories of court staff in each EU Member State, with a specific attention to their roles in implementing various aspects of EU law, as well as cross-border judicial cooperation; Describe the general organisation of court staff training at national level, and contact the main training providers; Pay specific attention to their training in EU law, organisation of other European judicial and legal systems and knowledge of legal terminologies in all EU Member States; Collect and analyse data (description and statistics) on existing training activities specifically on EU law aspects, be they organised at European, national, regional or local level; Work with training providers to assess needs regarding training in EU law aspects and develop recommendations; Provide a framework for direct initial contacts between training providers and promote their cooperation. The current Final Report describes the findings of the project, on the basis of the analysis of statistical data received as well as the input from the representatives of the training providers regarding training needs and ideas for future cooperation between training providers. Factsheets describing the various court staff categories have been established. A list of training providers and of participants in the project's meetings is a starting point for future involvement of court staff training providers at European level. Recommendations for actions at regional, national or European level to improve training of court staff in EU law as well as cooperation between national training providers stem from input from questionnaires as well as discussions in meetings and workshops.

Book excerpt: EU law only serves citizens if properly implemented. Training of justice professionals on EU law is essential to ensure the correct and coherent application of EU law across the EU, to improve mutual trust and to foster a common judicial European culture, including on the rule of law. This report measures the participation of legal practitioners in judicial training on EU law in the EU. At the same time, it supports the overall strategy on European judicial training by keeping the topic high on the political agenda. The report complements the Evaluation of the European judicial training strategy published in October 2019 and shows excellent results in terms of participation. In 2018, more than 190 000 legal practitioners took part in training on EU law or the law of another Member State. The yearly number of participants increased by 148 % between 2011 and 2018. In total, more than 1 million legal practitioners attended training on EU law since 2011. There has been an ever-increasing growth in the number of participants and training activities since 2011. The strategy led to an almost doubling of EU funds available for training legal practitioners and significant improvements in the capacity of networks and training providers such as the European Judicial Training Network (EJTN). The strategy's lasting effects are visible in improved knowledge of EU law, strengthened mutual trust and an increased level of cooperation among justice professionals in the EU Member States. Training providers and networks also consolidated their capacity for delivering training on EU law. In 2018, judicial training continued to respond to new training needs in particular by addressing rule of law challenges. A landmark-training programme for justice professionals on key issues of fundamental rights and rule of law was implemented starting from 2018, as part of the European Commission's strategy for the effective implementation of the EU Charter of Fundamental Rights. The aim was the strengthening a rule of law culture, by increasing the knowledge of the rule of law standards. The positive results achieved so far are an encouragement for going further and taking up new challenges. Both the evaluation and the current report confirm the need to reach better some categories of justice professionals, notably lawyers, court staff, and to further focus training on topics such as the rule of law and fundamental rights.

Book excerpt: Judicial training is vital for the development of a common judicial culture in the EU and for guaranteeing the homogeneous implementation of EC/EU law. The principle of mutual recognition existing in judicial cooperation since the Tampere Programme - and confirmed in the Hague Programme and the future Lisbon Treaty - entails a thorough knowledge of the various EC and EU instruments. Community financial programmes exist today to facilitate Member States' and other actors' training costs. The actors in the field of judicial training are in fact varied, even though the national schools play a core role. Various initiatives have suggested - or suggest - strengthening judicial training. Although all major stakeholders agree on the need to reinforce judicial training - and this can be seen in the various latest initiatives - there does not seem to be one distinct option to do so. This note seeks to summarise and analyse these initiatives and the reactions to them, as well as to make some operational recommendations on how to make the most effective use of the resources dedicated to this purpose.

Available in PDF, EPUB and Kindle. Book excerpt: Judicial networks have proved effective in influencing recent judicial policies enacted by both old and new EU member states. However, this influence has not been standard. This volume seeks to improve our understanding of how networks function, as well as the extent they matter in the governance of a constitutional democracy. The authors examine the judicial function of networks, the way they cross the legal and territorial borders that confine the jurisdiction of the domestic institutions, and whether or not they are independent of the capacity and the leadership of their members. A highly salient issue in contemporary law and politics, judicial networks are now qualified actors of governance. With the aim to understand how, to what extent, and with what consequences networks interact with hierarchical institutions that still exist within the States, this book is essential reading for legal experts, policy makers engaged in promoting the rule of law, members of the judicial networks in the EU and extra EU countries, as well as academics and students.

Book excerpt: The "Menu for Justice" project - funded with support from the European Commission - is the first European project that takes seriously the issue of how a new generation of Europeans should be trained in law and legal matters, as well as how experts in law and the judicial process can develop new skills and competences to effectively face the challenges of a common judicial space. The project takes up a major issue in contemporary judicial politics: to what extent and by which means can legally relevant expertise be supported to ensure an efficient, effective, and legitimate judicial system? This is not only a matter of policies and of the organization of judicial administrations, it is also a matter of how lawyers - and for more specific functions, judges - are trained considering the current, rapidly changing, societal circumstances. This book is a project report of "Menu for Justice." By devoting three years to the joint progress among 50 partners in Europe, the project assesses the key gaps in legal and judicial education in all European countries at all stages of education - from undergraduate, graduate, and PhD programs in universities to vocational training of lawyers and judges. By examining the "state of the art" of education for law students, lawyers, and judges in Europe, the "Menu for Justice" project offers vital information to policy makers considering the development of an innovative curriculum studiorum in judicial studies. It provides European institutions and the public with basic guidelines for monitoring the way legal and judicial training are changing in Europe. [Subject: Legal Education, European Law]

Book excerpt: . . . this book fills a significant gap in the English-language literature and must be read by all who seek to understand why profound reflection is needed on the theoretical underpinnings of EU criminal justice. Samuli Miettinen, Journal of Common Market Studies The book contains a number of interesting arguments and comments on the development of EU criminal law. . . the authors efforts to provide a generalist book in this ever-growing, increasingly important and still under-researched field of EU law must be welcomed. Valsamis Mitsilegas, The Edinburgh Law Review Today, EU criminal law and justice constitutes a significant body of law potentially affecting most aspects of criminal justice. This book provides a comprehensive, accessible yet analytically challenging account of the institutional and legal developments in this field to date. It also includes full consideration of the prospective changes to EU criminal law contained in the recent Lisbon Treaty . While, broadly speaking, the authors welcome the objectives of EU criminal law, they call for a profound rethinking of how the good of criminal justice however defined is to be delivered to those living in the EU. At present, despite sometimes commendable initiatives from the institutions responsible, the actual framing and implementation of the Area of Freedom, Security and Justice (AFSJ) suffers from a failure to properly consider the theoretical implications of providing the good of criminal justice at the EU level. Written shortly before the recent entry into force of the Lisbon Treaty, EU Criminal Law and Justice comprises a full overview of the key legal developments and debates and includes a user-friendly guide to the institutional changes contained in the Treaty. This timely book will be of interest to both undergraduate and postgraduate students, as well as to legal practitioners and policy makers at national and EU levels.

Book excerpt: This contributed volume examines the trend whereby the EU resorts ever more often to informal arrangements and deals with third countries in an effort to curb and manage migration flows towards the EU and facilitate the return of irregular migrants to their countries of origin or transit. The perceived success of the EU-Turkey deal provided a strong impetus for the continuation of this trend. The contributions collected and presented in this book aim to shed light on the implications of this trend for the EU constitutional order, the human rights of those affected by these deals, the third countries with which the EU cooperates, and the global refugee protection regime. They demonstrate how these deals raise more issues than they solve; by, for instance, sidestepping established Treaty rules and procedures, violating the human rights of those affected, and overburdening the nascent migration and asylum systems of third country partners. This book, the first volume to appear in the Global Europe Series, will be of great interest to researchers and policy makers working in the field of migration and asylum. Eva Kassoti and Narin Idriz work in the Research Department of the T.M.C. Asser Institute in The Hague.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive assessment of the effectiveness of Mobility Partnerships and their consequences for third countries. Mobility partnerships between the EU and third countries are usually viewed as reflecting asymmetric power relations where development aid, trade relations and visa policies are made conditional upon the cooperation by third countries with an EU agenda of migration control. This book argues that three main factors condition the relevance of Mobility Partnerships: the state of relations between EU Member States and a third country, and in particular, the role of postcolonial ties; the power of negotiation of a third country, which is linked to its geopolitical importance for the EU; and its administrative capacity, which is understood as the capacity of a state to define and implement policies and to legislate and enforce the law. The work combines a comparative legal analysis of the development of the legal and policy frameworks in the cases of Morocco and Cape Verde with an empirical study of the implementation of Mobility Partnerships’ projects. The analysis demonstrates that Mobility Partnerships, despite their non-binding nature, have legal and policy relevance for these third countries with regard to the regulation of migration, asylum, human trafficking and even labour law. As such, this book makes a contribution to the understanding of the interplay between the interests of EU, Member State and third country actors in the implementation of the Mobility Partnerships. The book will be a key resource for academics and students focusing on Migration Law, EU Studies, Geopolitics and African Studies. The empirical approach will also appeal to policy-makers, international organisation representatives and NGOs.

The Clean Development Mechanism (CDM), one of the three financial mechanisms under the Kyoto Protocol open to developing and developed countries, was devised to assist in mitigation of global warming. This book discusses what China should do to make full use of the CDM to promote sustainable development and to meet the challenge of climate change from a legal perspective. The findings lead to the conclusion that the CDM has limitations in promoting sustainable development in China, and thus should be regarded only as a complementary instrument in combating climate change. Legal strategies for improving the implementation of CDM projects under the legal framework in China are thus put forward, and some proposals for China to meet the challenge of climate change in the post-2012 era are made. This book offers new insights to academics and policymakers both in the public and private sector. It is intended for legal practitioners and researchers on carbon trading as well as policymakers interested in the role of developing countries in climate change law. In addition, it is of interest to stakeholders of CDM projects.
