Under corresponding section act of 1895, (section 20) a county treasurer could be compelled by mandamus to pay collected inheritance taxes to State Treasurer within a reasonable time after their collection by county treasurer, and revenue law sections 241 and 247 providing for settlement by county treasurer on April 15 and July 1 of each yearhas no bearing upon the question as to how long the county treasurer may retain such money. People v. Raymond, 188 Ill. 454. Section 21. Commission to County. Sec. 21. The treasurer of each county shall retain and pay into the county treasury two per cent (2%) on all taxes paid and accounted for by him under this act, in 'full for all services and expenses rendered, incurred or paid by the county or any of its officers, agents, or employees, in collecting and paying the same. (Amended by act approved June 25, in force July 1, 1915. Laws 1915, p. 572.) Section 21 as enacted in 1909 invalid as giving to county treasurers fees in excess of salary prescribed by Constitution, Art. 10, Sec. 9, and Fees and Salaries Act, Sec. 31. Jones v. 0'(/'0nnell, 266 Ill. 443. And county could not recover from county treasurer commissions retained by him under section 21 before its amendment, which was invalid. Lake County v. Westerfleld, 268 Ill. 537. Section 22. Inheritance Tax Receipts--Recording. Sec. 22.
