L'umanesimo classico si fonda su di un'alterità dissimile nella quale “l'altro” è colui che non possiede l'idea del giusto (athémistos): è il barbaro che non pratica la virtù ma esalta l'esercizio della violenza. L'umanesimo classico comprende una dimensione etica e una dimensione giuridica, converte una vita di anarchia e bruttezza, sinonimi d'ingiustizia, in una vita di equilibrio e bellezza, pilastri della giustizia e del diritto. Diversamente da quello contemporaneo, l'umanesimo Ellenico è edificato sulla diversità e non su quella somiglianza dei volti e delle esistenze, tipica dell'umanesimo moderno e postmoderno, per il quale ogni uomo, in quanto uomo, ha il medesimo valore ontologico.

Today we find ourselves confronted with an extreme form of this historical dynamic, as our TV screens and newspapers are filled with accounts of a 'migration crisis', ostensibly overwhelming Europe and portending the collapse of our way of life. This anxious debate has given rise to a veritable 'moral panic' - a feeling of fear spreading among a large number of people that some evil threatens the well-being of society. In this short book Zygmunt Bauman analyses the origins, contours and impact of this moral panic - he dissects, in short, the present-day migration panic. He shows how politicians have exploited fears and anxieties that have become widespread, especially among those who have already lost so much - the disinherited and the poor. But he argues that the policy of mutual separation, of building walls rather than bridges, is misguided. It may bring some short-term reassurance but it is doomed to fail in the long run. We are faced with a crisis of humanity, and the only exit from this crisis is to recognize our growing interdependence as a species and to find new ways to live together in solidarity and cooperation, amidst strangers who may hold opinions and preferences different from our own.

Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.
