Available in PDF, EPUB and Kindle. Book excerpt: This book starts with the prevailing idea of a conflicting relationship between Islam and the Western concept of democracy, both in theory and in practice. With this backdrop, the author addresses the crucial question—Is Islam compatible with democracy? The book offers very useful discussions in framing the contemporary debates surrounding Islam and democracy, treads through diverse theoretical Islamic texts like the ‘Quran’ and ‘Sunnah’, discusses the historical evolution of the concept of Shura—the primary source of democratic ethics in Islam, provides an assessment of the views and visions of some selected Muslim scholars (from 19th to 21st centuries) on Islam–democracy compatibility, and examines the elements of compatibility between Islam and democracy without ignoring the basic differences that exist between the Western approach to democracy and Islamic political thought.

Book excerpt: Islamization and Activism in Malaysia examines aspects of the increasing political and social profile of Islam in Malaysia and describes how different kinds of activists in Malaysia have sought to protect fundamental liberties and to improve the state of democracy in Malaysia. In particular, focus is paid to activists who engage with electoral process, the law and the public sphere, and in particular, to movements that cut across or combine these realms of action. Spanning the period of the Prime Ministership of Abdullah Badawi, Julian C. H. Lee's grounded analysis examines the most important issues of that period including the freedom of religion case of Lina Joy, the Islamic state debate, and events surrounding the 8 March 2008 general elections.

Book excerpt: This book examines different brand of women’s feminist struggles and focuses on the struggles of Muslim women who are insiders in the Islamic Movement, as represented in Nigerian Muslim women’s Islamic activism. Drawing on different secular-Islamic Gender feminist theoretical frameworks, the book closely analyses Islamic texts and these Muslim women brand of feminism, which reflect the effects of their strong Islamic commitment culture on their gender relations, postulations and feminist struggles in general. It argues that the Islamic texts portray the pre-modern basis of these Muslim women Islamic feminism—born in the Prophetic era before the secular feminist movement, contrary to the common notion of the Islamic endorsement of Muslim women stereotypical backwardness, domestication and patriarchal domination. This book demonstrates how Muslim women writers have used Islamic organizations to work for, and contribute to, feminist changes.

Book excerpt: This multidisciplinary volume explores the role of Islamic law within the dynamic processes of postcolonial transformation, nation building, and social reform. Here, eleven international scholars examine Islamic law in several contemporary sociopolitical contexts, focusing specifically on Malaysia, Indonesia, Pakistan, China, Tunisia, Nigeria, the United States, and the International Islamic Fiqh Academy (IIFA) of the Organization of Islamic Cooperation (OIC). The contributors also address the entanglement of Islamic law and ethics with the history of Muslim religious discourses, shifts toward modernity, gender relations, and efforts to construct exclusive or plural national communities. Sharia Dynamics, at once enchanting and enlightening, is a must-read for scholars of contemporary Islam.

This book was released on 2010-10-22 with total page 507 pages. Available in PDF, EPUB and Kindle. Book excerpt: a. The set generally: [Please note that the following description applies to both volumes in the 2009 Yearbook, not solely to Volume I]. The Global Community Yearbook is a one-stop resource for all researchers studying international law generally or international criminal tribunals specifically. The Global Community Yearbook appears annually in two-volume editions of carefully chosen primary source material and corresponding expert commentary. The general editor, Professor Giuliana Ziccardi Capaldo, employs her vast expertise in international law to select excerpts from important court opinions and also to choose experts from around the world who contribute essay-guides to illuminate those cases. Although the main focus is recent case law from the major international tribunals and regional courts, the first volume of each year''s edition always features expert articles by renowned scholars who address broader themes in international law, themes that appear throughout the case law of the many courts covered by the series as a whole. b. This particular edition (2009): This year''s edition of the Global Community Yearbook is restructured to update its format and to better respond to its objective. The change affects the section entitled Decisions of International Courts and Tribunals; all other sections will remain the same. This section, divided into twelve sub-Sections, presents annually the more significant international case law in the form of "legal maxims," systematically collected. The elaboration of legal maxims, extracted from the courts'' decisions, and their systematic classification makes this year''s edition of the Yearbook unique. International courts and tribunals have developed remarkably in recent years, and it is becoming increasingly difficult to follow the case law emanating from those jurisdictions without the help of an intermediary. The Yearbook and its unique changes fill this gap by serving as an intermediary between the case law and international scholars, practitioners, and students. In previous issues of the Yearbook, these legal maxims were prepared by referring both to the law and often extensively to the specific facts of the case. In the new format, the "legal maxims" will now distil the most important elements of judicial decisions and rely less heavily on the facts. The text of the legal maxims has been reduced to the minimum necessary for systematic classification, printing the website links for the case law. An introductory note on each international tribunal or court continues to be provided as a synopsis of their activity over the year. This reduction of the text of legal maxims better responds to the goals of the Yearbook to serve as a mediator and to provide complete coverage of case law from international courts and tribunals. c. Individual volumes: The first volume of the 2009 edition of Global Community Yearbook presents three categories of material wholly beneficial to any international law-researcher: International tribunals'' court opinions, excerpted with scholarly skill by General Editor Giuliana Ziccardi Capaldo; expert guidance on those cases in the form of commentary by globally recognized luminaries whom Ziccardi has chosen personally; and more broadly focused introductory essays by similarly prominent scholars whom Ziccardi has also selected for that purpose. In the introductory essays, those scholars take on the current, controversial topics of the case against criminalizing hate speech, the global importance of human rights for environmental protection, the evolution of international environmental law, and the politics of global powers. Those incisive and knowledgeable introductory articles help frame the debates currently raging in international law before this volume leads the reader on to expert commentary on the noteworthy cases from this past year''s dockets of the following tribunals: *The International Court of Justice *The WTO Dispute Resolution System *The International Criminal Court *International Criminal Tribunal for the Former Yugoslavia *International Criminal Tribunal for Rwanda Ziccardi has arranged the sections of this volume according to that list of tribunals, and she has included a short, targeted index for each of those sections, making any research in this volume efficient and fruitful. Volume 2: This second volume of the 2009 edition of Global Community Yearbook gives researchers an illuminating tour through the varied and dynamic law of regional and organizational courts. In the court opinion excerpts and expert commentary that fill this volume, researchers will find detailed guidance on a rich diversity of legal topics, from whether the European Court of Human Rights is effective as the centerpiece of the European human rights protection system to the jurisdictional challenges by respondent States under applicable investment agreements. On these questions and a host of others, this volume provides to students, scholars, and practitioners alike a valuable combination of expert discussion and direct quotes from the court opinions to which that discussion relates. The courts covered by this particular volume are: *The Court of First Instance of the European Communities *The Court of Justice of the European Communities *The European Court of Human Rights *Inter-American Court of Human Rights *International Centre for the Settlement of Investment Disputes

Book excerpt: Compelling and original, this book offers a unique insight into the modern Islamic corporation, revealing how power, relationships, individual identities, gender roles, and practices - and often massive financial resources - are mobilized on behalf of Islam. Focusing on Muslims in Malaysia, Patricia Sloane-White argues that sharia principles in the region's Islamic economy produce a version of Islam that is increasingly conservative, financially and fiscally powerful, and committed to social control over Muslim and non-Muslim public and private lives. Packed with fascinating details, the book is essential reading for anyone with an interest in Islamic politics and culture in modern life.

Available in PDF, EPUB and Kindle. Book excerpt: Civilizations and World Order: Geopolitics and Cultural Difference examines the role of civilizations in the context of the existing and possible world order(s) from a cross-cultural and inter-disciplinary perspective. Contributions seek to clarify the meaning of such complex and contested notions as “civilization,” “order,” and “world order”; they do so by taking into account political, economic, cultural, and philosophical dimensions of social life. The book deals with its main theme from three angles or vectors: first, the geopolitical or power-political context of civilizations; secondly, the different roles of civilizations or cultures against the backdrop of “post-coloniality” and “Orientalism”; and thirdly, the importance of ideological and regional differences as factors supporting or obstructing world order(s). All in all, the different contributions demonstrate the impact of competing civilizational trajectories on the functioning or malfunctioning of contemporary world order.
